HomeMy WebLinkAboutSpecial Exception AnalysisANALYSIS FOR SPECIAL EXCEPTION Approximately the entire block bounded by NW 6th Avenue on the East, NW 7th Avenue on the West, NW 8th Street on the North and NW 7th Street on the South CASE NO. 2005-0985 Pursuant to Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed to allow the following Special Exception: • Special Exception per Article 9, Section 949, to bring a legally nonconforming freestanding personal wireless service facility monopole into compliance. The Special Exception requires City Commission approval The following findings have been made: • It is found that the request is to bring an existing legal nonconforming monopole for personal wireless services into compliance. • It is found that the subject property is also the subject of a zoning change request as part of an application for a Major Use Special Permit for the Urban River project. • It is found that the proposed project will consist of at least one tower greater in height than the monopole; therefore, the monopole should be located on the roof of the new proposed structure in order to mitigate the adverse aesthetic impacts associated with such a pole to the adjacent neighborhood. • It is found that the existing monopole is legally grandfathered under the previous "Industrial" zoning classification and is therefore requesting to remain in the interim until the new tower is constructed. Based on these findings, the Planning Department is recommending approval with conditions of the requested personal wireless service facilities (PWSF) with the following conditions: 1. The requested personal wireless service facilities (PWSF) (monopole) may remain in its current location until such time as the first of the proposed residential towers receives a CO; at that time, the facility shall be relocated to the rooftop of the residential tower. 2. The applicant shall submit a landscape plan for the area of the property upon which the current personal wireless service facility (PWSF) is located.
