River Drive, Miami, Florida. Purpose of Item: Authorizing City Manager to execute a Revocable License Agreement with Garcia Brothers Wholesale, Inc. for the use of the property located at 236 SW N. River Drive, Miami, Florida, for use as a wholesale and retail seafood and dockage facility on a month -to -month basis; providing for: (i) payment of the greater of a monthly use fee of $7,000.00 or percentage fee of 3% of gross receipts; (ii) payment of the prospective annual submerged land fees as may be required pursuant to Florida Department of Environmental Protection (DEP); (iii) payment of $1,000 per month as payment towards retroactive submerged land fees to be required by DEP for prior usage of submerged lands; and (iv) Licensee's use of the Submerged Lands Area shall be subject to any restrictions set forth by DEP for the use of said property; with terms and conditions as more particularly set forth in th.e Agreement. ' . .i 2Ar Dept. Director/1 City Manager Page 1 of 2 a�� Subject: Revocable License Agreement for the use of 236 SW N. River Drive, Miami, Florida. Background Information: The City issued a Request for Letters of Interest ("RFLI") for the use of the property located at 236 SW N River Drive. Four proposals were received in response to said RFLI. On June 6, 2005, an Evaluation Committee selected by the City Manager ranked the proposals received as follows: (1) Garcia Brothers Wholesale, Inc. (2) Miami River Lobster & Stone Crab, Corp. (3) Casablanca Fish Market, Inc. (4) Emerald Yacht & Ship Management, Inc. The City Manager accepted the recommendation of the Evaluation Committee, who recommended that the City negotiate with the number one ranked Proposer and in the event negotiations fail, the City should then proceed in rank order to negotiate with the second and third ranked Proposers, It should be noted that the City does not currently have a lease from the State Department of Environmental Protection (DEP) for the submerged lands area adjacent to the City's upland property at 236 SW N River Drive, although said submerged lands have been utilized in connection with the upland property for over 30 years. The City anticipates entering into a Temporary Use Agreement and/or Submerged Lands Lease Agreement in the near future and DEP has indicated back fees will be due for such unauthorized prior use. Garcia Brothers Wholesale, as the prior party utilizing the submerged lands, has agreed to pay $1,000 per month as additional consideration. Therefore, this Agreement provides that either party may terminate the Agreement in the event a Temporary Use Agreement and/or Submerged Lands Lease Agreement is not received from DEP. Page 2 of 2
