A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT OF TEMPORARY
CONSTRUCTION EASEMENT, IN SUBSTANTIALLY THE ATTACHED FORM,
WITH STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ("GRANTEE"),
FOR THE PURPOSE OF GRANTING GRANTEE THE RIGHT TO USE
APPROXIMATELY 0.101 ACRES OF CITY -OWNED PROPERTY LOCATED AT
1400 NORTHWEST 37TH AVENUE, MIAMI, FLORIDA, ALSO KNOWN AS
MELREESE GOLF COURSE, AS MORE PARTICULARLY DESCRIBED IN
"EXHIBIT A," ATTACHED AND INCORPORATED, AS A CONSTRUCTION
STAGING AREA FOR A PERIOD NOT TO EXCEED SEVEN MONTHS.
WHEREAS, the City of Miami ("City") is the owner of certain real property and improvements
located at 1400 Northwest 37th Avenue, Miami, Florida, also known as Melreese Golf Course
("Property"); and
WHEREAS, the State of Florida Department of Transportation ("Grantee") has requested it be
granted a temporary construction easement on City property that will be used in connection with the
construction of bridge structures for the Miami Intermodel Connector Interchange for storing and
removing equipment materials, vehicles and supplies, with full right of ingress thereto and egress
therefrom; and
WHEREAS, this easement is necessary in order for the Grantee to provide a construction staging
area using a portion of the Property to complete construction of the bridge structures and
reconstruction of LeJeune Road for the Miami Intermodel Connector Interchange;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized(1) to execute a Grant of Temporary Construction
Easement, in substantially the attached form, with the Grantee, for the purpose of granting Grantee the
right to use approximately 0.101 acres of the Property, as more particularly described in "Exhibit A,"
attached and incorporated, as a construction staging area for a period not to exceed seven months.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
