A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO SUBMIT AN APPLICATION TO THE FLORIDA FISH & WILDLIFE
CONSERVATION COMMISSION ("FWC"), FOR THE BOATING
INFRASTRUCTURE GRANT PROGRAM, FOR THE DREDGING OF THE
BRENNAN CHANNEL AT DINNER KEY MARINA PROJECT ("PROJECT"), FOR
THE DEPARTMENT OF CONFERENCES, CONVENTIONS AND PUBLIC
FACILITIES, IN AN AMOUNT NOT TO EXCEED $1,000,000; AUTHORIZING THE
ALLOCATION OF REQUIRED MATCHING FUNDS FOR TWENTY-FIVE PERCENT
(25%) OF THE PROJECT COSTS, IN AN AMOUNT NOT TO EXCEED $250,000,
FROM THE HOMELAND DEFENSE BOND CAPITAL IMPROVEMENT PROJECT
NO. 326015, B-30247, ENTITLED "DINNER KEY MARINA DREDGING;" FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY
DOCUMENTS, FOR SUBMISSION OF THE FWC GRANT APPLICATION FOR
FISCAL YEAR 2005-2006 AND TO ACCEPT THE TERMS AND CONDITIONS AS
STATED HEREIN AND SUBJECT TO SAID GRANT APPLICATION.
WHEREAS, the City of Miami ("City") wishes to dredge an area at the Dinner Key Marina extending
from the Seminole Public Dinghy Dock toward the Atlantic Intracoastal Waterway ("Project"); and
WHEREAS, the estimated cost of the Project is $1,000,000; and
WHEREAS, the City wishes to apply for grant funding from the Florida Fish and Wildlife ("FWC") for
the Project in the amount of $750,000 with the City contributing twenty-five percent (25%), toward the
estimated $1,000,000 Project; and
WHEREAS, the City is committed to provide resources necessary to operate and maintain the
waters surrounding Dinner Key Marina, for a period of twenty years and is willing to enter into a twenty
year agreement for said services;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings found in the Preamble of this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to submit an application to the FWC, for the Boating
Infrastructure Grant Program ("BIGP"), for the Project, for the Department of Conferences,
Conventions and Public Facilities, in an amount not to exceed $1,000,000.
Section 3, The allocation of required matching funds for twenty-five percent (25%) of the Project
costs, in an amount not to exceed $250,000, from the Homeland Defense Bond Capital Improvement
Project No. 326015, B-30247, entitled "Dinner Key Marina Dredging," is authorized.

Section 4. The City Manager is further authorized{1 } to execute the necessary documents, for
submission of the FWC grant application for Fiscal Year 2005-2006 and to accept the terms and
conditions subject to said grant application.
Section 5. The City accepts the terms and conditions set forth in the BIGP application which is part
of the Project.
Section 6. The City is in complete accord with the proposal and agrees to carry out the Project in
the manner described in the proposal and will make no change to any plans and/or specifications
without prior approval from the FWC.
Section 7. The City agrees to provide twenty years of maintenance involved in the Project
dependent upon the City's continued ownership of the Dinner Key Marina property as described above.
Section 8. The Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
