HomeMy WebLinkAboutLegislation FR/SRCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 05-00694 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING AND APPROPRIATING THE 2005 SERIES SPECIFIED/PER CAPITA SAFE NEIGHBORHOOD PARKS BOND FUNDS GRANT, IN THE AMOUNT OF $3,000,024; AMENDING ORDINANCE NO. 12622, AS AMENDED, APPROPRIATING SAID FUNDS INTO THE CAPITAL IMPROVEMENT PROJECT NUMBERS SPECIFIED HEREIN; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENT(S), IN FORMS AND SUBSTANCE ACCEPTABLE TO THE CITY ATTORNEY AND THE RISK MANAGEMENT ADMINISTRATOR, FOR ACCEPTANCE OF THE GRANT; AND AUTHORIZING, PURSUANT TO THE PROVISIONS OF THE SAFE NEIGHBORHOOD PARK ORDINANCE, THE PAYMENT OF (1) SUPPLEMENTAL FUNDS REQUIRED TO COMPLETE SAID PROJECTS IF THE COST OF SAID PROJECTS EXCEED 1 HE GRANT ALLOCATION, AND (2) FUNDS TO OPERATE, MAINTAIN AND PROVIDE PROGRAMMING AT EACH PROJECT UPON ITS COMPLETION. WHEREAS, the citizens of Miami -Dade County authorized the issuance of general obligation bonds for the purpose of financing capital improvement programs for certain parks, beaches, natural areas and recreation facilities; and WHEREAS, to implement and give effect to the bond program, Miami -Dade County enacted Ordinance No. 96-115, the Safe Neighborhood Parks Ordinance ("Ordinance"); and WHEREAS, the City of Miami has been awarded funds in the amount of $3,000,024 for the Series 2005 Specified/per Capita Safe Neighborhood Park Bond Program of Miami -Dade County, pursuant to all terms and conditions of the Ordinance; and WHEREAS, said funds will be appropriated in to the Capital Improvement projects as specified herein; and WHEREAS, it is necessary to reallocate first series Homeland Defense/Neighborhood Improvement Bond funds from Capital Project Nos. 341212 to 341211 to commence design for Project No. B-40686, Miami River Greenways/Streetscape Segment D (East Little Havana); NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The award/grant of the Series 2005 Specified/per Capita Safe Neighborhood Park Bond Funds in the amount of $3,000,024 from Miami -Dade County, is accepted. Section 3. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during Fiscal Year 2005. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior funds. The sources of revenues to support the herein appropriations are hereby identified by fund and project in ten Capital Funds, as follows: V. The City Manager is authorized{2} to execute the necessary document(s), in forms and substance acceptable to the City Attorney and the Risk Management Administrator, with Miami -Dade County to accept the Series 2005 Safe Neighborhood Park Bond Funds. Section 5. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 6. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
