Background Information: 1) The Related Group, a renowned and reputable developer, will be constructing "50 Biscayne", a primarily residential development consisting of 529 dwelling units and 15,000 s.f. of retail between Biscayne Boulevard and NE 3rd Avenue with frontage along Flagler Street. 2) The construction of "50 Biscayne" is estimated to begin shortly after the City, with its contractor MCM Corporation, is scheduled to complete the $9.1 million Flagler Marketplace Streetscape Project. Direct Chief City Manage Risk Manageme J/4 tr 1 o Page i of 2 Background Information cont'd: 3) In an effort to save money, prevent the duplication of work and avoid the mobilization of two contractors in the same area, the City decided it would be in the best interest of all parties to have the Related Group complete the construction work on the Flagler Streetscape Project for the portion bordering its development, on Flagler Street from Biscayne Boulevard to NE 3`d Avenue. The City, through MCM Corporation, will provide the granite paving materials necessary to construct the improvements and the Related Group will construct the improvements when it is ready, at its own cost. The attached Assignment and Assumption Agreement details the responsibilities of the parties, including the provision of performance and payment bonds. Should Related fail to complete work on the assigned portion within 30 months, the City may withhold or delay the certificate of occupancy for the development. This item is related to another resolutii that will amend the Construction contract with MCM to allow an assignment such as this with City approval. Page 2 of 2
