Dear Mr. Walford:
The Miami -Dade County Aviation Department (MDAD) has reviewed the City of Miami
Large Scale Development report for January, 2005. Based on the available information,
there are seven applications that fall into restrictive zones as depicted in the land use
zoning ordinance for Miami International Airport (MIA):
Aguaclara 1960-70 NW 27th Avenue is inside the Outer Land Use Zone (OLZ) and
Critical Approach Departure Surface Area (CA-B).
Allapattah Project NW 36th St. /37th Avenue is inside the Outer Land Use Zone (OLZ)
and Critical Approach Departure Surface Area (CA -A).
pinnacle Plaza 3650-90 NW 36th Street is inside the Outer Land Use Zone (OLZ) and
Critical Approach Departure Surface Area (CA -A).
Century Plaza 850 NW Le Jeune Rd is inside the Outer Safety Zone (OSZ), the Outer
Land Use Zone (OLZ) and Critical Approach Departure Surface Area (CA -A).
The Towers at Blue Lagoon 4865 NW 7th Street Avenue is inside the Outer Land Use
Zone (OLZ) and Critical Approach Departure Surface Area (CA -A).
River Run South 2415 NW 16th Street Road Avenue is inside the Outer Land Use Zone
(OLZ) and Critical Approach Departure Surface Area (CA-B).
Brisas Del Rio SE Comer of NW 24th Avenue & NW 16th Street Rd. is inside the Outer
Land Use Zone (OLZ) and Critical Approach Departure Surface Area (CA-B)-
The Ordinance states the following for the OSZ: "new residential construction,
educational facilities (excluding aviation related schools), and buildings for public
assembly in excess of 1,000 persons are prohibited within this zone. It is provided,

however, that the prohibition on buildings for public assembly shall not apply to hotels,
motels, or hospitals and their ancillary uses. Additionally, the prohibition on buildings for
public assembly as provided herein shall not apply to structures used in connection with
public transportation. There shall be no variance pertaining to the residential and
educational uses prohibited herein nor any variance permitting a use for public assembly
other than as permitted in this paragraph."
The Ordinance states the following for the OLZ: "new residential construction
constructed after the effective date of this ordinance and educational facilities (excluding
aviation related schools) within this land use zone are only perritted where not otherwise
prohibited and where a minimum of 25 decibel (db) Noise Level Reduction (NLR)
materials are incorporated in the design and construction of the structure."
Based on the information provided in the large Scale Development Report, there is no
indication that educational facilities (which include day care facilities) are included in the
plans for the proposed developments. Please note, however, that a number of these
proposed development sites fall within CA zones.
Please be advised that all applications are subject to Miami -Dade County's Land Use
Zoning Ordinance for MIA (# 04-203) adopted as amended on November 30, 2004.
While MDAD will make every effort to target impacted zoning applications, it is
advisable for the City of Miami to conduct their own analysis and then request comments
from MDAD if needed.
