TBD EXHIBIT "C" (GENERAL - with Safety Requirements) This exhibit forms an integral part of that certain Joint Participation Agreement between the State of Florida, Department of Transportation and CITY OF MIAMI, DEPARTMENT OF CAPITAL IMPROV I NT PROGRAM AND TRAI 'ORTATION 444 SW 2nd Avenue, 10hI Floor, Miami, Florida 33130-19.1Q dated Safety Requirements Bus Transit System - In accordance with F'ioricta. Statute 34 '061, and Rule Chapter 14-90, Florida Administrative Code, the Agency shall submrf;'arldthp Department shall have on file, an annual safety certification that the Agency has adopted.and is complying with its adopted System Safety Program Plan pursuant to Rule; Chapter 14-90 and has performed annual safety inspections of all buses operated. XXFixed Guideway Stystem - (ostabijshed) In accordance with Florida Statute 341.061, the Agency shall submit, and the._Qepartment shall have on file, ar:tnual certification bytho Agency of compliance with its System Safety Program ptiii'i.pArspant to Ru1e,Chapter 14-55. XX_ Fixed Guideway System (hew) In accordance with Florida Statute 341,061, the Agency shall submit a certriicatiori iltesting to the. adoption of a System Safety Program Plan pursuant to Rule Chapter 14- .5$ Prior to begrnrtfng passenger service operations, the Agency shall submit a certification to the Department that the System rs.safe for passenger service. Program FUnding & Protect Requirements Department funding is provided from the Department's Transit Urban Capital Program. This project shall be conducted in accordance with the guidance for that program and with all applicable State of Florida Statutes. State participation rate is up to 50% of the non -Federal share of eligible project expenses, Department funding is provided solely for the Alternatives Analysis, Environmental Documentation, Preliminary Engineering and Program/Project Management support associated with the proposed construction of 6.75 mile round trip loop of trackway for the Miami Streetcar Project. Eligible project costs are limited to; (1) Program/project management (2) FTA Alternatives Analysis and required environmental documentation (3) Development of Affected agency agreements. (GENERAL - with Safety Requirements) (4) Public involvement (5) Florida East Coast Railway coordination (6) Certification of City of Miami with FTA. (7) Development of project funding submittal to FTA (8) DBOM procurement documents, evaluation and selCtton support (9) Ridership sensitivity analysis (10) Financial analysis/support (11) Preliminary Engineering Agency personnel expenses and all travel expenses shall not be:.eligible for reimbursement under this Agreement. No other costs incurred by the Agency shall be reimbursed by the Department. Purchasing, Payments & Reporting Requirements The Agency shall obtain prior" writlen.concurreht;e. from the Department for any third party purchases exceeding $10,000. Failure fo obtain prior concurrencemay result in non-payment by the Department. Environmental DocumentatiorsRequirements The project wflf ib developed in Conformance with all applicable State and Federal environmental laws and permitting requirements If thiS project receives Federal financial assistance, the lead Federal agency will require that the Agency complyWilh the NEPA process. It this project is completed without Federal financial assistance, the National Et yironmentat Policy Act (N EPA) process may not be applicable. In the absence of a Federally required examination of potential corridors or segments thereof, the Agency shall contact the Department to determine the scope of any additional environmental evaluation deemed necessary by the Department, such as a State Environmental Impact Report (SEIR). Other Requirements This is a Pre -Qualified JPA and funding will be identified in State Fiscal Year (SFY) 2007. Therefore, funding for this Agreement will not be available until the beginning of SFY 2007, subject to state legislative appropriation for that SFY. No eligible costs incurred under this agreement can be reimbursed until the SFY 2007 funds are encumbered.
