with attachments, authorizing
the Bayfront Park
Management Trust to enter
into a concession license
agreement, in substantially the
attached form, with Skylift
Holding, LLC, for the purpose
of managing and operating a
tethered balloon ride at
Bayfront Park.
RECOMMENDATION
It is respectfully recommended that the Miami City Commission adopt the attached Resolution
authorizing the Bayfront Park Management Trust to enter into a concession license agreement with
Skylift Holding, LLC, for the purpose of managing and operating a tethered balloon ride at Bayfront
Park.
BACKGROUND
The Bayfront Park Management Trust (Trust) manages Bayfront and Bicentennial Parks with the
goal of ensuring maximum community participation. One of the Trusts's near term objectives,
identified through its recent long range planning process, is to create a 12-16 hour a day facility
serving the community with various forms of entertainment and activities. The acquisition of a
tethered balloon ride at the Park was recognized as a tactic for achieving that objective. At the
Trust's request, the City of Miami Procurement Department issued a Request for Letters of Interest
(RFLI) to solicit proposals for that purpose. RFLI No. 03-04-101R for the Management and
Operation of a Tethered Balloon Ride at Bayfront Park was issued on April 12, 2004, and two (2)
responses were received. The Bayfront Park Procurement Evaluation Committee ("Committee"),
appointed by the Chairperson of the Trust and approved by the City Manager, met on two (2)
occasions, including the final meeting held on June 15, 2004, at which time oral presentations were
provided by both of the two (2) proposers. Following the oral presentations, the Committee
completed its evaluation of the two (2) Proposers, and recommended the firms in the following
order, stipulating that should negotiations fail with the first ranked firm, the Trust should then
negotiate with the second ranked firm: 1. Skylift Holding, LLC; 2. Miami Balloon Company, Inc.
The City Manager approved the Committee's finding as did the Trust at its July 26, 2004, board
meeting. The City of Miami Commission on September 9, 2004, adopted resolution R 04-0566
authorizing the Trust to negotiate a revocable license agreement with Skylift Holding, LLC.
Negotiations ensued and produced an amenable concession license agreement, in substantially the
attached form, that the Trust approved at its June 27, 2005, board meeting, through resolution no.
05-032, subject to Army Corp of Engineers approval. The Army Corp of Engineers approved the
concession license agreement on , 2005. Additionally, attached hereto for your approval
please find the concession license agreement between the Bayfront Park Management Trust and
Skylift Holding, LLC, for the operation of a tethered balloon ride at Bayfront Park.
