A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1, IN
SUBSTANTIALLY THE ATTACHED FORM, TO THE LOCALLY FUNDED
AGREEMENT BETWEEN THE FLORIDA DEPARTMENT OF TRANSPORTATION
AND THE CITY OF MIAMI, PURSUANT TO RESOLUTION NO. 04-0691, ADOPTED
OCTOBER 28, 2004, FOR THE BISCAYNE BOULEVARD CROSS STREETS
CONVERSION PROJECT, B-33100, IN AN AMOUNT NOT TO EXCEED $20,595,
INCREASING THE TOTAL CONTRACT AMOUNT FROM $90,000 TO $110,595;
ALLOCATING FUNDS IN AN AMOUNT NOT TO EXCEED $20,595, FROM
CAPITAL IMPROVEMENTS PROJECT NO. 341330 ENTITLED "CITYWIDE
TRANSPORTATION AND TRANSIT," FOR SAID PURPOSE.
WHEREAS, Resolution No. 04-0691, adopted October 28, 2004, authorized the execution of a
Locally Funded Agreement ("LFA"), in the amount of $82,500 plus an additional 10% contingency of
$7,500 for a total contract amount of $90,000, for the conversion of Northeast 9th, Northeast 10th and
Northeast 11th Streets between Northeast 2nd Avenue and just east of this segment of Biscayne
Boulevard, Miami, Florida, from a one-way operation to a two-way operation; and
WHEREAS, the low bid amount received by Florida Department of Transportation ("FDOT"), was
$103,095, which is $20,595, higher than the total contract amount of $90,000; and
WHEREAS, FDOT requested the difference of $20,595 and has since received the second
contingency of $7,500, resulting in a balance of $13,095; and
WHEREAS, Amendment No. 1 increases the contract in an amount not to exceed $20,595, to
provide the remaining $13,095, for the project and replenish the second contingency in the amount of
$7,500;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized(1) to execute Amendment No. 1, in substantially the
attached form, to the LFA between the FDOT and the City of Miami, pursuant to Resolution No. 04-
0691, adopted October 28, 2004, for the Biscayne Boulevard Cross Streets Conversion Project, B-
33100, in an amount not to exceed $20,595, increasing the total contract amount from $90,000 to
$110,595, with funds in an amount not to exceed $20,595, allocated from Capital Improvements
Project No. 341330 entitled "Citywide Transportation and Transit," for said purpose.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.(2)

{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
