Low laid is $20,595 iIigher than JPA Contract Amount
Dear Ms. Conway:
In response to notification from FDOT Central Office regarding the low bid amount received as a result of the May 25,
2005, letting for the subject project:
This letter will serve as the Florida Department of Transportation's (Department's) official written notice to the City of
Miami (City) that additional local funds are needed in order to fund construction for the subject project Please see the
enclosed Locally Funded JPA, executed between the Department and the City on December 10, 2004. Specific reference is
made to Section 2, Paragraph (c), which states:
"]1'the accepted bid amount plus allowances is in excess of the advance deposit amount, the CITY will
provide an additional deposit within fourteen (14) calendar days of notification from the
DEPARTMENT or prior to posting of the accepted bid, whichever is earlier, so that the total deposit is
equal to the bid amount plus allowances?'
The Department received a wire transfer from the City on January 27, 2005, in the amount of Eighty -Two Thousand Five
Hundred Dollars ($82,500.00). This amount was inclusive of a 10% contingency allowance totaling Seven Thousand Five
Hundred Dollars ($7,500.00). In addition, the City agreed to set aside a second 10% contingency allowance totaling Seven
Thousand Five Hundred Dollars ($7,500.00) that was not included in the amount wire transferred. This was to alleviate the
need for additional City Commission approval should the low bid come in slightly higher than the projected $82,500.00.
The low bid for the subject project was One Hundred Three Thousand Ninety -Five Dollars ($103,095.00), Twenty
Thousand Five Hundred Ninety -Five Dollars ($20,595,00) higher than the JPA contract amount. At this time, the
Department is requesting: 1) payment of the second contingency allowance that was set aside; and 2) that the City, if
required to do so, approach the City Commission for approval of the remaining Thirteen Thousand Ninety -Five Dollars
($13,095.00), calculated as follows:

City Commission to approve: $13,095.00
Time is of the essence as we approach the end of our. current Fiscal Year 2004/05 on June 30, 2005. Although the
Department understands that there may not be enough time to request. City Commission approval of the full amount due, the
Department would like to request of the City the timely transfer of the second contingency allowance as expeditiously as
possible.
