HomeMy WebLinkAboutExhibit 4Exhibit "B" CITY RESOLUTION Page 7 of 7 Locally Funded Agreement between the Florida Department of Transportation and the City of Miami, Financial Project ID 4249833-2.52-02 City of Miami Certified Copy City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fLus File Number: 04-01144 Enactment Number: R-04-0691 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A LOCALLY FUNDED AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION TO PROVIDE FUNDS FOR THE "BISCAYNE BOULEVARD CROSS STREETS CONVERSION PROJECT" TO CONVERT NORTHEAST 9TH, 10TH, AND 11TH STREETS FROM NORTHEAST 2 ND AVENUE TO BISCAYNE BOULEVARD, FROM ONE-WAY OPERATIONAL TO TWO-WAY OPERATIONAL STREETS, IN AN AMOUNT NOT TO EXCEED $82,500; ALLOCATING FUNDS FROM CAPITAL IMPROVEMENT PROJECT ("CIP") NO. 341330, ENTITLED "CITYWIDE TRANSPORTATION AND TRANSIT;" AUTHORIZING THE CITY MANAGER TO APPROVE ADDITIONAL PAYMENTS IN AN AMOUNT NOT TO EXCEED $7,500, FROM THE RETAINED CONTINGENCY FUND IN THE EVENT ADDITIONAL MONIES ARE NEEDED FOR CHANGE ORDERS; ALLOCATING FUNDS FROM THE ABOVE -MENTIONED CIP ACCOUNT. WHEREAS, the Florida Department of Transportation ("FDOT") will be constructing a project on State Road 5/Biscayne Boulevard from Northeast 5th Street to Northeast 13th Street, designated as Financial Project Identification ("ID") Number 249835-2-52-01; and WHEREAS, the City of Miami ("City") is the owner of the right-of-way and intends to convert Northeast 9th, Northeast 10th, and Northeast 11 th Streets between Northeast 2nd Avenue and just east of this segment of Biscayne Boulevard, from a one-way operation to a two-way operation; and WHEREAS, the City has requested that FDOT include the work of converting these three side streets in the construction contract for Biscayne Boulevard ("Project:); and • WHEREAS, the parties agree that it would be more cost and time effective to have FDOT construct the Project; and WHEREAS, the City has prepared a set of construction plans for the Project, which have been accepted by FDOT and designated as State Financial Project ID Number 249835-2-52-02; and WHEREAS, the City will provide funding in the amount of $82,500, to FOOT for the construction of the Project, in advance, as described in "Exhibit A" to the Locally Funded Agreement ("Agreement"), attached and incorporated; and WHEREAS, the Department of Capital Improvements and Transportation requests that the City Manager be given additional authorization to permit future additional payments up to $7,500 if required as a result of changes to work in progress; and WHEREAS, the FDOT and the City have determined that it would be to the best interest of the general public to enter into this agreement; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 3 R-04-0691 File Number: 04-01144 Enactment Number: R-04-0691 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized(1) to execute an Agreement, in substantially the attached form, with FDOT to provide funds for the "Biscayne Boulevard Cross Streets Conversion Project" to convert Northeast 9th, 10th, and 11 th Streets from Northeast 2nd Avenue to Biscayne Boulevard, from one-way operational to two-way operational streets, in an amount not to exceed $82,500, with funds allocated from Capital Improvement Project ("CIP") No. 341330 entitled "Citywide Transportation and Transit." Section 3. The City Manager is authorized{1} to approve additional payments in an amount not to exceed $7,500, from the retained contingency fund in the event additional monies are needed for change orders, with funds allocated from the above -mentioned CIP account. Section 4.
