HomeMy WebLinkAboutordinance FR-SRCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www,clmiamLfl.us File Number: 05-00485 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE VISECTION 54-190 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE BUILDING LINES/NONSTANDARD STREET WIDTHS," BY MODIFYING THE WIDTH OF THE NORTH SIDE OF NORTHEAST 16TH STREET BETWEEN NORTHEAST 2ND AVENUE AND BISCAYNE BOULEVARD, MIAMI, FLORIDA; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article V of Chapter 54 of the Code of the City of Miami, Florida, as amended ("City Code"), establishes base building line locations for all public streets within the City of Miami ("City"); and WHEREAS, Northeast 16th Street between Northeast 2nd Avenue and Biscayne Boulevard, Miami, Florida was originally dedicated as a 25 foot wide roadway; and WHEREAS, the zoned street width of this roadway was increased to 50 feet wide but the north side has not been dedicated or developed to the 50 foot width; and WHEREAS, the City Administration's review of this transportation corridor reveals that the current developed roadway adequately serves the present and future vehicular transportation needs of the public and permits the continued protection of the historic building at 1601 Northeast 2nd Avenue, Miami, Florida; and WHEREAS, to continue the protection of the existing historic building compatible with the new development now being realized in this area, a reduction in the zoned street width of the north side of Northeast 16th Street between Northeast 2nd Avenue and Biscayne Boulevard, Miami, Florida, from 50 feet to 25 feet is warranted; and WHEREAS, the Departments of Police, Fire -Rescue and Solid Waste have evaluated the effect of the reduction of the zoned street width of this section of Northeast 16th Street, Miami, Florida, on their operations and have no substantial objections; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORI DA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 54/Article V/Section 54-190 of the City Code entitled "Streets and Sidewalks/Base Building Lines/Nonstandard Street Widths," is amended in the following City of Miami Page 1 of 3 Printed On: 5/23/200 File Number: 05-00485 particulars:{1 } "CHAPTER 54 STREETS AND SIDEWALKS ARTICLE V. BASE BUILDING LINES Sec. 54-190. Nonstandard street widths. Base building lines shall be located from the centerline as specified for each of the following streets: Streets, Avenues, Roads Etc., in Alphabetical Order: Distance in Feet from Centerline to Base Building Line (58A) 16th Street, N.E., north side Biscayne Boulevard to N.E. 2nd Avenue 12.5 Section 3. All Ordinances or parts of Ordinances that are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 4. If any Section, part of a section, paragraph, clause, phrase or work of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5.
