HomeMy WebLinkAboutR-05-0422City of Miami Legislation Resolution: R-05-0422 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-00606 Final Action Date: 7/7/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A "PROJECT CIVIC ACCESS" AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND THE UNITED STATES OF AMERICA, DEPARTMENT OF JUSTICE, UNDER THE AMERICANS WITH DISABILITIES ACT, SUBJECT TO THE TERMS AND CONDITIONS OF THE AGREEMENT. WHEREAS, the United States Department of Justice ("Department") initiated an investigation as a compliance review of the City of Miami ("City"), under Title II of the Americans with Disabilities Act of 1990 ("ADA"), 42 United States Code ("U.S.C.") §§ 12131-12134, and the Department's implementing regulation, 28 Code of Federal Regulations ("C.F.R.") Part 35; and WHEREAS, because the City received financial assistance from the Department, the review was also conducted under the authority of Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 794, and the Department's implementing regulation, 28 C.F.R. Part 42, Subpart G; and WHEREAS, the review was conducted by the Disability Rights Section of the Department's Civil Rights Division and focused on the City's compliance with Title II requirements; and WHEREAS, the Department is authorized to determine the City's compliance and to negotiate and secure voluntary compliance agreements; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a "Project Civic Access" Agreement ("Agreement"), in substantially the attached form, between the City and the United States of America, Department of Justice, under the ADA, subject to terms and conditions of the Agreement. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: City of Miami Page 1 of 2 File Id: 05-00606 (Version: 11 Printed On: 11/21/2016 File Number: 05-00606 Enactment Number: R-05-0422 {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
