HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 05-00591 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE EXECUTIVE DIRECTOR OF THE BAYFRONT PARK MANAGEMENT TRUST ("TRUST") TO EXECUTE A PROFESSIONAL SERVICE AGREEMENT WITH CHRISTMAS DESIGNERS, INC., FOR THE PURCHASE, INSTALLATION, REMOVAL, BULB REPLACEMENT AND SECURE STORAGE OF A 50-FOOT HOLIDAY TREE FOR PLACEMENT IN BAYFRONT PARK, FOR A FIVE-YEAR PERIOD, AT A FIRST -YEAR COST NOT TO EXCEED $81,103.90 AND FOR THE SUBSEQUENT YEARS (SECOND YEAR THROUGH FIFTH YEAR), AT AN ANNUAL COST NOT TO EXCEED $18,420, PLUS A CONTINGENCY AMOUNT OF $23,800.41, FOR A TOTAL CONTRACT AMOUNT NOT EXCEED $118,584.31; ALLOCATING FUNDS FROM THE TRUST'S OPERATING AND CAPITAL IMPROVEMENT BUDGETS. WHEREAS, the Bayfront Park Management Trust ("Trust") was created by the Miami City Commission to direct, operate, manage and maintain all aspects of Bayfront Park and Bicentennial Park; and WHEREAS, one of the Trust's objectives, is to create a holiday gathering destination for the City of Miami's ("City's") residents and visitors alike; and WHEREAS, the Trust considered the acquisition of a holiday tree as a means to achieve this goal; and WHEREAS, on March 10, 2005, the City's Department of Purchasing along with the Trust, issued Request for Letters of Interest No. 04-05-032, for the procurement of a holiday tree; and WHEREAS, two (2) responses were received by March 30, 2005; and WHEREAS, on April 12, 2005, the Trust Evaluation Committee ("Committee") reviewed the proposals submitted; and WHEREAS, as a result of discussion and deliberation, the Committee determined Christmas Designers, Inc., to be the most qualified and responsive bidder; and WHEREAS, the City Manager approved the recommendation made by the Committee; and WHEREAS, on May 23, 2005, the Trust met at its monthly board meeting and approved the Committee's recommendation to accept the proposal submitted by Christmas Designers, Inc. through Resolution No. 05-021.1 and directed the Executive Director to enter into a five-year Professional Service Agreement ("Agreement") with Christmas Designers Inc., subject to City Commission approval; and City of Miami Page 1 of 2 Printed On: 6/22/2005 File Number: 05-00591 WHEREAS, funds are allocated in the Trust's 2004-2005 Operating & Capital Budgets and each subsequent year through the term of the Agreement; and WHEREAS, the Trust and the Executive Director of the Trust recommend that the proposal received by Christmas Designers, Inc., be accepted as the most responsive and responsible bid; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Executive Director of the Trust is authorized{1 } to execute an Agreement with Christmas Designers Inc., for the purchase, installation, removal, bulb replacement, and secure storage of a 50-foot holiday tree for placement in Bayfront Park, for a five-year period, at a first year cost not to exceed $81,103.90 and for the subsequent years (second year through fifth year), at an annual cost not to exceed $18,420, plus a contingency amount of $23,800.41, for a total contract amount not exceed $178,584.31, with funds allocated from the Trust's Operating and Capital Improvement Budgets. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS:'' ORGEL.F;-�` CITY A ONEY NDEZ Footnotes : {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
