Pursuant to Article 4, Section 401 of Ordinance 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for an
amendment to the Zoning Atlas as follows:
The request is to change the Zoning designation as follows:
The subject property consists of multiple lots adjacent to the FEC Railroad right-of-
way, east of the former Buena Vista rail yard, and to the rear of the commercial
structures facing NE 2nd Avenue (Complete legal description on file at the Hearing
Boards Office), from C-1 "Restricted Commercial" and C-2 "Liberal Commercial"
to C-1 "Restricted Commercial" with an SD-20 "Edgewater Overlay District",
The following findings have been made:
• It is found that the C-1 "Restricted Commercial" zoning designation is immediately
adjacent to the subject properties; however, the requested change to SD-20
"Edgewater Overlay District" zoning designation is not a logical designation for the
subject properties.
• It is found that the intent of SD-20 "Edgewater Overlay District" is to provide
development incentive for general Edgewater/Omni area between Northeast 2nd
Avenue to Biscayne Bay. It is also found that the boundaries of this application is
outside the intended SD-20 "Edgewater Overlay District".
• It is found that the C-1 "General Commercial" category allows 150 units per acre by
Special Exception only, and the requested C-1 "Restricted Commercial" category
allows 150 units per acre.
• It is found that a zoning change to SD-20 "Edgewater Overlay District" at this
location may set a negative precedent and create a "domino effect" in regards to
future zoning change application.
Based on these findings, the Planning Department is recommending approval of the
C-1 "Restricted Commercial" and denial of the SD-20 "Edgewater Overlay
District".
