Ganguzza offered the following resolution and moved its adoption Resolution: AFTER CONSIDERING THE FACTORS SET FORTH IN SECTION 1903.1 OF ORDINANCE NO. 11000, THE ZONING BOARD RECOMMENDED APPROVAL TO THE CITY COMMISSION OF THE VARIANCE AS PART OF A MAJOR USE SPECIAL PERMIT FOR THE VISTA BISCAYNE PROJECT, FROM ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, ARTICLE 6, SECTION 620.2.3.1, REQUIRED FRONT YARD, TO ALLOW A FRONT YARD SETBACK OF 50" (20'0" REQUIRED) FOR THE PROPERTIES LOCATED AT APPROXIMATELY 436, 446 AND 452 NORTHEAST 29TH STREET, LEGALLY DESCRIBED AS EXHIBIT "A" (HEREBY ATTACHED), PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA; ZONED R-4 MULTIFAMILY HIGH -DENSITY RESIDENTIAL WITH AN SD-20 EDGEWATER OVERLAY DISTRICT. THIS VARIANCE WAS RECOMMENDED APPROVAL TO THE CITY COMMISSION PER PLANS ON FILE WITH A TIME LIMITATION OF TWENTY-FOUR MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED, SUBJECT TO THE FOLLOWING CONDITION BY THE PLANNING AND ZONING DEPARTMENT: THE APPROVAL OF THIS VARIANCE SHALL BE PER PLANS ON FILE AND THE PROJECT SHOULD COMPLY WITH THE DESIGN COMMENTS AND CONDITIONS OF THE INTERNAL DESIGN REVIEW COMMITTEE AND THE MUSP DEVELOPMENT ORDER.
