A RESOLUTION OF THE MIAMI CITY COMMISSION BYA FOUR -FIFTHS (4/5THS)
AFFIRMATIVE VOTE, AFTER A PUBLIC HEARING, PURSUANT TO SECTION
2-614 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY
CODE"), WAIVING THE CONFLICT OF INTEREST PROVISIONS CONTAINED IN
SECTION 2-612 OF THE CITY CODE, AS RELATED TO STATE CERTIFIED
FIREFIGHTERS/ EMERGENCY MEDICAL TECHNICIANS, TO ENABLE THEM TO
PROVIDE BASIC LIFE SUPPORT TRAINING AND EDUCATION IN COMPLIANCE
WITH THE CITY OF MIAMI SAVE A LIFE FOUNDATION GRANT PROJECT.
WHEREAS, pursuant to Resolution No. 04-0629, adopted September 23, 2004, the City
Commission authorized the City Manager to accept a grant from the Save a Life Foundation, in the
amount of $100,000, for the promotion of training and education in basic life support for children and
adolescents within the Miami High Feeder Pattern which is comprised of the following schools: Miami
Senior High, New World School of the Arts, Citrus Grove Middle, Shenandoah Middle, Citrus Grove
Elementary, Coral Way Elementary, Shenandoah Elementary and Kensington Park Elementary; and
WHEREAS, certified Firefighters/Emergency Medical Technicians are employed as certified
emergency medical technicians ("EMTs") and/or paramedics of the City of Miami ("City") Department
of Fire -Rescue; and
WHEREAS, those certified Firefighters/Emergency Medical Technicians are uniquely and
specifically qualified to provide basic life support training and education in compliance with the City's
"Save a Life Foundation Grant Program" and receive compensation pursuant to the terms of the
grant; and
WHEREAS, Section 2-612 of the Code of the City of Miami, Florida, as amended ("City Code"),
prohibits an employee of the City from entering into any contract or transacting any business with the
City; and
WHEREAS, Section 2-614 of the City Code allows the City Commission to waive such
prohibitions if the transaction, which herein consists of the certified firefighters teaching the Save A
Life Foundation classes and making necessary appearances, if warranted, on behalf of the Save a
Life Foundation before any City Commission, board or agency, are in the best interest of the City; and
WHEREAS, the transaction would address the need to provide basic life support training and
education to youth in the Miami High Feeder Pattern Schools cited above and other schools, civic,
charitable, educational, scientific or civic groups, associations and entities within the City, selected by
the Fire Chief, therefore consistent with Section 2-614 and the waiver serves the City's best interest;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, after a public hearing, pursuant to Section 2-
614 of the City Code, the conflict of interest provisions contained in Section 2-612 of the City Code,
are waived as related to state certified Firefighters/Emergency Medical Technicians, to enable them to
provide basic life support training and education in compliance with the City of Miami Save a Life
Foundation Grant Project.
Section 3. The waiver set forth in Section 2 hereof is based upon the following findings:
1) The transaction consists of services that are unique and would address the need to provide
basic life support training and education to youth in the Miami High Feeder Pattern Schools as
follows: Miami Senior High, New World School of the Arts, Citrus Grove Middle, Shenandoah Middle,
Citrus Grove Elementary, Coral Way Elementary, Shenandoah Elementary and Kensington Park
Elementary, and other schools, civic, charitable, educational, scientific or civic groups, associations
and entities within the City, selected by the Fire Chief; and
2)The transaction is in the best interest of the City.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor{1}.
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
