HomeMy WebLinkAboutresolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miaml.fl.us File Number: 05-00544 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A RELEASE, DISCHARGE AND WAIVER OF REVERTER ("REVERTER RELEASE"), IN SUBSTANTIALLY THE ATTACHED FORM, FOR A PORTION OF NORTHEAST 20TH STREET FROM MARGARET PACE PARK WEST TO BISCAYNE BOULEVARD, MIAMI, FLORIDA, AS MORE LEGALLY DESCRIBED IN THE ATTACHED REVERTER RELEASE, IN CONNECTION WITH THE DEVELOPMENT OF A PROJECT IN THE OMNI COMMUNITY REDEVELOPMENT AREA. WHEREAS, Resolution No. 01-1127, adopted October 25, 2001, authorized the City Manager to issue a deed containing certain restrictions and conditions conveying a portion of Northeast 20th Street from Margaret Pace Park west to Biscayne Boulevard ("Property"), to the City of Miami ("City") Omni Community Redevelopment Agency ("Omni CRA") for the purpose of inducing economic development in the area; and WHEREAS, the Omni CRA conveyed the Property to Finger Biscayne, LLC., a Florida limited liability corporation ("Finger Biscayne"), containing the same restrictions and conditions as included in the City's deed to the Omni CRA; and WHEREAS, Finger Biscayne has requested that the City release its reverter on the Property as the conditions on the deed have been fulfilled; and WHEREAS, the Departments of Building, Planning and Zoning have confirmed that Finger Biscayne has satisfied and complied with all of the conditions pursuant to said Resolution and the deed; and WHEREAS, Finger Biscayne has released all legal rights, title and interest in Margaret Pace Park pursuant to a certain release dated March 4, 2002 and recorded in the public records of Miami -Dade County, Florida; NOW, THEREFORE, BE 1T RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a Release, Discharge and Waiver of Reverter ("Reverter Release"), in substantially the attached form, for the Property, as more legally described in the attached Reverter Release, in connection with the development of a project in the Omni Community Redevelopment area. Section 3.
