HomeMy WebLinkAboutO-12693City of Miami Legislation Ordinance: 12693 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-00380 Final Action Date: 6/9/2005 AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT GRANT FUNDS, IN THE TOTAL AMOUNT OF $2,000,000, FROM THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT"), TO PROVIDE FUNDING, IN THE AMOUNT OF $1,000,000, FOR THE MIAMI RIVERWALK EXTENSION: FLAGLER STREET BRIDGE AREA PROJECT B-40691 (SEGMENT B) AND B-40692 (SEGMENT C) AND $1,000,000 FOR THE EAST LITTLE HAVANA GREENWAY PROJECT, B-40686 (SEGMENT D); AMENDING ORDINANCE NO. 12622, AS AMENDED, TO APPROPRIATE SAID CONTRIBUTION OF FUNDS INTO CAPITAL IMPROVEMENT PROJECT NO. 341211, ENTITLED "GREENWAYS IMPROVEMENTS;" AUTHORIZING THE ALLOCATION OF THE CITY'S CONTRIBUTION TO THE FLAGLER STREET BRIDGE AREA PROJECT IN A TOTAL AMOUNT NOT TO EXCEED $337,700; ALLOCATING SAID FUNDS, IN THE AMOUNT NOT TO EXCEED $150,000, FROM THE PARKING SURCHARGE AND AN AMOUNT NOT TO EXCEED $187,700, FROM THE HOMELAND DEFENSE NEIGHBORHOOD IMPROVEMENT BOND PROGRAM; AUTHORIZING THE CITY MANAGER TO EXECUTE A LOCAL AGENCY PROGRAM AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE FLAGLER STREET BRIDGE AREA PROJECT, TO IMPLEMENT ACCEPTANCE OF SAID GRANTS; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Department of Transportation ("FDOT") with the approval of the Metropolitan Planning Organization, awarded federal grants to the City of Miami ("City"), in the total amount of $2,000,000, for the construction of the Miami Riverwalk Extension: Flagler Street Bridge Area Project, B-40691 (segment B) and B-40692 (segment C) and the East Little Havana Greenway Project, B-40686 (segment D); and WHEREAS, the City's contributions to the Flagler Street Bridge Area Riverwalk totals $337,700 and are from the following sources: $150,000 from Parking Surcharges and $187,700 from the Homeland Defense Neighborhood Improvement Bond Program; and WHEREAS, these Projects will provide outdoor recreational opportunities and an alternative transportation corridor for people living and working along the river to easily and safely walk or bike to mass transit connectors; and WHEREAS, the proposed riverwalk extension for the Flagler Street Bridge Area, Segments B and C, will run along North River Drive from approximately Northwest 2nd Street to Southwest 2nd Street (1-95); and WHEREAS, the proposed riverwalk extension for the East Little Havana Area, Segment D, will run along South River Drive from approximately Northwest 1st Street to Northwest 7th Avenue; and City of Miami Page 1 of 3 File Id: 05-00380 (Version: 11 Printed On: 11/17/2016 File Number: 05-00380 Enactment Number: 12693 WHEREAS, this grant was awarded with the support of the Trust for Public Land ("Trust") and the Miami River Commission and are consistent with the Miami River Greenways Action Plan, adopted in principle by the City in May 2001; and WHEREAS, the attached Local Agency Program Agreement ("LAP Agreement") for the Flagler Street Bridge Area Project provides the terms and conditions for the City's use of the funds for the Project; and WHEREAS, the LAP Agreement for the East Little Havana Greenway Project will be presented to the City Commission at a later date for approval; and WHEREAS, said grant funds, in the total amount of $2,000,000, will be appropriated into Capital Improvement Project No. 341211, entitled "Greenways Improvements;" NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings found in the Preamble of this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to accept grant funds from the State of Florida Department of Transportation ("FDOT"), in the total amount of $2,000,000, to provide funding in the amount of $1,000,000 for the Miami Riverwalk Extension: Flagler Street Bridge Area Project, B-40691 (segment B) and B-40692 (segment C), and $1,000,000 for the East Little Havana Greenway Project, B-40686 (segment D) and appropriate said funds into Capital Improvement Project No. 341211, entitled "Greenways Improvements." Section 3. Ordinance No. 12622, as amended, adopted December 9, 2004, the Capital Projects Appropriations Ordinance, is amended in the following particulars:{2} "Ordinance No. 12622 Section 1. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during Fiscal Year 2005. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior funds. The sources of revenues to support the herein appropriations are hereby identified by fund and project in ten Capital Funds, as follows: Appropriations 24. 341211 Greenways Improvements Funding Sources: City of Miami Page 2 of 3 File Id: 05-00380 (Version: 11 Printed On: 11/17/2016 File Number: 05-00380 Enactment Number: 12693 a. Homeland Defense/Neighborhood Improvement Bonds $ 1,438,913 b. Florida Department of Transportation Grant 2,000,000 Total $ 1,438,913 $ 3,438,913 *11 Section 4. The allocation of the City's contribution to the Flagler Street Bridge Area Project, in a total amount not to exceed $337,700 is authorized, with said funds allocated in an amount not to exceed $150,000 from the Parking Surcharges and, an amount not to exceed $187,700, from the Homeland Defense Neighborhood Improvement Bond Program. Section 5. The City Manager is further authorized{1} to execute the LAP Agreement, in substantially the attached form, for the Flagler Street Bridge Area Project, to implement acceptance of said grants. Section 6. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 7. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 8. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor.{3} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {3} This ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
