HomeMy WebLinkAboutordinance FR-SRCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.cl.miami.fl.us File Number: 05-00379 Final Action Bate: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE BUILDING LINES/ NONSTANDARD STREET IDTHS," TO MODIFY THE WIDTH OF NORTHEAST 7 TH STREET, NORTHEAST 8TH STREET, NORTHEAST 10TH STREET AND NORTHEAST 11TH STREET, BETWEEN NORTHEAST 2ND AVENUE AND BISCAYNE BOULEVARD, MIAMI, FLORIDA, CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article V of Chapter 54 of the Code of the City of Miami, Florida, as amended (City Code"), establishes base building line locations for all public streets within the City of Mimi ("City"); and WHEREAS, Northeast 7th Street, Northeast 8th Street, Northeast 10th Street and Northeast 11th Street between Northeast 2nd Avenue and Biscayne Boulevard were originally dedicated as 50 foot wide roadways; and WHEREAS, the zoned street width of these roadways was increased to 75 feet wide but has not been dedicated or developed to the 75 foot width; and WHEREAS, the City's Administration review of these transportation corridors reveals that the current 50 foot wide developed roadway adequately serves the present and future transportation needs of the public; and WHEREAS, to accommodate the pedestrian and traffic impacts, utility and access needs compatible with new development now being realized in this area, a reduction in the zoned street width of Northeast 7th Street, Northeast 8th Street, Northeast 10th Street and Northeast 11th Street between Northeast 2nd Avenue and Biscayne Boulevard from 75 feet to 50 feet is warranted; and WHEREAS, the Departments of Police, Fire -Rescue and Solid Waste have evaluated the effect of the reduction of the zoned street width of these roadways on their operations and have no substantial objections; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 54/Article V/Section 54-190 of the City Code, as amended, entitled Streets and Sidewalks/Base Building Lines/Nonstandard Street Widths, is amended in the following particulars: j'1} City of Miami Page I of 3 .Printed On: 5/2/2005 File Number: 05-00379 "CHAPTER 54 STREETS AND SIDEWALKS * * ARTICLE V. BASE BUILDING LINES Sec. 54-190. Nonstandard street widths Base building lines shall be located from the centerline as specified for each of the following streets: Streets, Avenues, Roads Etc/. In Alphabetical Order: Distance in feet from Center Line to Base Building Line (22) 7th Street, N.E. and N.W., Bissay♦ae-Boulevard N.E. 2nd Avenue to N.E. 1st Avenue 37.5 (24) 8th Street, N.E. and N.W., Bisoayne-BoulevardN.E. 2nd Avenue to N.E. 1st Avenue and North Miami Avenue to N.W. 3rd Avenue (32) 10th Street, N.E. and N.W., N.E. 2nd Avenue to Florida East Coast Railway right-of-way (33) 11th Street, N.E. and N.W., Biscayne -Boulevard N.E. 2nd Avenue to Florida East Coast Railway right-of-way 37.5 37.5 37.5 Section 3. All ordinances or parts of ordinances that are inconsistent or in conflict with the provisions of this Ordinance are repealed. If any Section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective 30 days after final reading and adoption thereof. {2} APPROVED A TO FORM AND CORRECTNESS:t Footnotes: {1 } Words and/or figures stricken through shall be deleted. If the Mayor vetoes this Ordinance, it shall before effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
