HomeMy WebLinkAboutresolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.uu File Number: 05-00477 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), VACATING, DISCONTINUING AND ABANDONING THE EAST TEN (10) FEET OF LOT 14, BLOCK 5, "PARKERS FLAGLER HEIGHTS," ACCORDING TO THE PLAT THEREOF, RECORDED IN PLAT BOOK 18, PAGE 32, OF THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A QUIT CLAIM DEED, IN SUBSTANTIALLY THE ATTACHED FORM, REVERTING SAID RIGHT OF WAY BACK TO THE ABUTTING PROPERTY OWNERS. WHEREAS, a request has been made to vacate, discontinue and abandon the east ten (10) feet of Lot 14 granted to the City of Miami ("City") in 1951 in a deed of dedication for highway purposes only as recorded in OR Book 3480, Page 577 of the Public Records of Miami -Dade County, Florida; and WHEREAS, said east ten (10) feet of Lot 14 which lies within Block 5, "Parkers Flagler Heights," according to the plat thereof, recorded in Plat Book 18, Page 32 of the Public Records of Miami -Dade County, Florida, is not being utilized by the City; and WHEREAS, the City Commission has established a zoned right of way width of fifty (50) feet for Northwest 47th Avenue between Northwest 1st Street and Northwest 2nd Street, Miami, Florida and said east ten (10) feet of Lot 14 is not included within the zoned right of way; and WHEREAS, all utility companies have been contacted and have expressed no objection to the vacation, discontinuing and abandoning of the said east ten (10) feet of Lot 14; and WHEREAS, it has been determined that it would not be detrimental to the interest of the City or its citizens to relinquish the aforesaid east (10) feet of Lot 14, and any reason to do so would prevent the present owners from utilizing the property for its highest and best use; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The east ten (10) feet of Lot 14, Block 5, "Parkers Flagler Heights," according to the plat thereof, recorded in Plat Book 18, Page 32, of the Public Records of Miami -Dade County, Florida, is vacated, discontinued and abandoned. Section 3. The City Manager is authorized{1} and directed to execute a Quit Claim Deed, in substantially the attached form, reverting the right of way back to the abutting property owners. Section 4. F: NANDEZ "..4 7 CITY A TOR EY T Footnotes : {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. if the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
