HomeMy WebLinkAboutLegislationCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.cL iami.fl.us File Number: 04-01242 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY AMENDING ARTICLE 6, MORE PARTICULARLY BY AMENDING SECTION 617.2.2.2 (1) (b) TO CHANGE THE AMOUNT CHARGED FOR PARKING FEES IN THE SD-17 OVERLAY DISTRICT, WHERE BONUS PARKING IS PERMITTED, FROM PREVAILING RATES FOR PUBLIC METERED PARKING IN THE VICINITY, AS ESTABLISHED BY THE MIAMI DEPARTMENT OF OFF- STREET PARKING TO A SET AMOUNT; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE, AND AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of March 02, 2005, Item No. 8, following an advertised hearing, adopted Resolution No. PAB 22-05 by a vote of six to zero (6-0), RECOMMENDING APPROVAL to amend Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Article 6, Section 617.2 of the Zoning Ordinance of the City of Miami, Florida, Ordinance No. 11000, is amended in the following particulars:{1} "Zoning Ordinance Sec. 617.2. Effect of SD-17 district designation. 617.2.2.2. Allowable increase in floor area for buildings providing certain supporting uses; limitations. For properties located between Mary Street, McFarlane Avenue, South Bayshore Drive and a portion of Grand Avenue, which contain an SD-17 Overlay designation, the maximum floor area may be increased for all buildings in conformance with the following provisions and limitations: 1. Public parking: For every one (1) public parking space that a building provides in excess of offstreet parking requirements, an additional three hundred fifty (350) square City of Miami Page 1 of 2 Printed On: 4/1/2005 File Number: 04-01242 feet of floor area for any use permitted in the underlying zoning district shall be permitted; provided, however: * b. Parking fees charged shall not be in excess of prevailing rates for public metered parking in the vicinity, as established by the Miami Department of Offstreet Parking, but in no event shall the rate be set below $1.25 per hour; Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof. {2} APPROVED AS TO FORM AND CORRECTNESS: JORGE L. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
