Dear Ms. Dougherty:
Notwithstanding the fact that Jerin Associates, Inc. ("JA") disputes virtually all of
the representations made by the Applicant at the April Planning Board Meeting
as well as the April Zoning Board hearing, Jerin Associates desires to make it
clear that to the extent that the Applicant is willing to scale back the Bayview
Marketplace project in a manner that is consistent with existing zoning
entitlements and in a manner that provides a building foot print that does not
trample upon Jerin Associates' use of its property or is otherwise not offensive to
its property rights, that Jerin Associates would be willing to consider removing
any opposition to the subject project.
Failing any written confirmation of JA's assent to the submitted project, Jerin
Associates will continue to avail itself of the opportunity to defend its vested
property rig
