Subject: Resolution to permit a wall encroachment into the public righht-of-way
Purpose of Item:
A Resolution, in accordance with Section 54-191 of the City Code directing that an existing wall
encroachment be permitted to remain within the dedicated public right-of-way of Crawford Avenue
adjacent to the side of 3730 Solana Road.
Background Information:
In response to citizens' requests and in the best interest of the City's communities, the City
Commission adopted Ordinance No. 11277 on April 27, 1995, amending the City Code to provide a
mechanism to permit an existing fence, hedge or wall encroachment into the dedicated right-of-way,
constructed prior to March 24, 1983, to remain.

RESOLUTION TO PERMIT A WALL ENCROACHMENT INTO THE PUBLIC
RIGHT OF WAY
In consideration of the rights under Ordinance 11277, the property owner at 3730 Solana
Road has submitted a request to the Director of Public Works to permit an existing wall
encroachment from the property to remain within Crawford Avenue along the side of the
home. Since the wall encroaches into the dedicated right of way of Crawford Avenue by
approximately 1 to 2 feet, this request is being presented to the City Commission along
with the County property appraiser's evidence furnished by the owner to prove that the
wall was constructed prior to March 24, 1983. The owner has requested that the City
permit the existing wall to remain. The wall otherwise conforms with the requirements of
the City's Zoning Ordinance and the Florida Building Code. A search of City records
reveals that no documented complaints or reports of problems of impediment to travel by
vehicles or pedestrians attributed to the wall are contained in City records.
It is respectfully recommended that the existing wall encroachment be perrnitted to
remain in the dedicated right of way of Crawford Avenue subject to a Covenant to Run
with the Land and payment of fees required by the City Code.
