HomeMy WebLinkAboutR-05-0319City of Miami Legislation Resolution: R-05-0319 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-00421 Final Action Date: 5/26/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN EMERGENCY RELIEF PROGRAM AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION ("FDOT") TO UNDERTAKE AND COMPLETE CERTAIN EMERGENCY RELIEF EFFORTS FROM THE DAMAGE INFLICTED BY HURRICANE FRANCES IN SEPTEMBER, 2004, ASSOCIATED WITH FEDERAL AID HIGHWAYS OR ROADS ON FEDERAL LANDS WITHIN ITS JURISDICTION AS DEFINED BY THIS PROGRAM; FURTHER AUTHORIZING THE CITY MANAGER TO SUBMIT RELATED CLAIMS TO FDOT AS DESCRIBED IN THE ATTACHED DETAIL DAMAGE INSPECTION REPORT, INCORPORATED HEREIN AS "EXHIBIT A" AND TO ACCEPT PAYMENTS FOR SAME. WHEREAS, in September 2004, Hurricane Frances produced disastrous conditions which had a devastating impact upon South Florida; and WHEREAS, pursuant to Title 23, United States Code, §125, an Emergency Relief Program was made available to the City of Miami ("City") as a result of Hurricane Frances; and WHEREAS, an Emergency Relief Program Agreement ("Agreement") allows the State of Florida, Department of Transportation ("FDOT") to act as the administrator on behalf of the Federal Highway Administration for the reimbursement of Emergency Relief Program funding for damaged inflicted by said storm associated with Federal aid highways or roads on federal lands within its jurisdiction as defined by this program; and WHEREAS, the City Manager recommends adoption of this Resolution which will enable the City to accept funds from FDOT, through the State of Florida, as reimbursement for eligible costs incurred by the City for disaster relief activities described in the attached Detailed Damage Inspection Report ("DDIR"), incorporated herein as "Exhibit A;" NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, with FDOT, to undertake and complete certain emergency relief efforts from the damage inflicted by Hurricane Frances in September, 2004, associated with Federal aid highways or roads on federal lands within its jurisdiction as defined by this program. The City Manager is further authorized{1} to submit related claims to FDOT as described in the attached DDIR, incorporated herein as "Exhibit A" and to accept payments for same. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
