Inc. Purpose of Item: A Resolution, by an affirmative vote of four -fifths (4/5ths) of the members of the Miami City Commission, ratifying the City Manager's written finding to waive competitive negotiation procedures for the provision of after school educational programs and cultural and recreational activities for youths (primarily ages 6 through 12 mainly in the 1st through 6th grade levels), at the City -owned property located at 353 SW 4th Street, Miami, Florida, commonly known as Jose Marti Park ("Park"); authorizing the City Manager to execute a Park Programming Agreement ("Agreement"), in substantially the attached form, with Amigos Together for Kids, Inc. ("Provider"), a Florida non-profit corporation, for said services and providing for: (1) a term of three (3) years that shall commence on the Effective Date, with an option to extend for up to two (2) consecutive additional three (3) year periods; (2) payment to the City of Miami of One Dollar and 00/100 ($1.00) per month; and (3) Provider shall be responsible for any costs associated with its programs, including but not limited to, security, equipment and insurance during its operating hours at the Park, and with terms and conditions as more particularly set forth in the Agreement. Background Information: Provider is interested in offering after school programs, academic instruction and cultural and recreational activities to youths primarily ages 6 through 12 mainly in the 1st through 6th grade levels of the families and residents in the surrounding community of the Park and the City of Miami. Provider's educational programs may include homework assistance to children primarily ages 6 through 12 from the 1s through 6th grade levels, educational trips throughout the school year, and computer skills to children of all levels. Staff from the organization offer beverages and snacks to all its youth participants and also provides assistance to Jose Marti Park personnel in the maintenance of the Community Center at the Park related to the programs. Section 18-86(a)(3)(c) provides for the award of services related to cultural, educational, recreational or park activities provided by non-profit organizations within City parks without competitive negotiations, if the City Manager makes a written finding to the City Commission that competitive negotiation methods are not practicable or advantageous, which finding must be supported by reasons (as set forth in the attached memo from the Director of the Department of Parks and Recreation), ratified and the award approved by an affirmative vote of four -fifths of the City Commission after a ro•erly advertised public hearing, Budget Imnact Analysis YES Is this item related to revenue?
