HomeMy WebLinkAboutresolution•1111011134> City of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami•fl.us� File Number: 05-00374 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE ACQUISITION AND INSTALLATION OF FOUR (4) IOMEGA FREEDOM E-SERVER DATA STORAGE DEVICES, FOR THE DEPARTMENT OF POLICE, FROM THE DICTAPHONE CORPORATION, THE SOLE SOURCE PROVIDER, TO INCLUDE MAINTENANCE FOR FIVE (5) YEARS, FOR A TOTAL AMOUNT NOT TO EXCEED $114,650.75; ALLOCATING FUNDS FROM THE E-911 OPERATING BUDGET, ACCOUNT CODE NO. 196003.290531.6.840; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, FOR SAID PURPOSE. WHEREAS, Resolution No. 03-650, adopted June 12, 2003, authorized the sole source acquisition and installation of the Freedom Call Recording and Archiving recording system from the Dictaphone Corporation ("Dictaphone") with a storage retention of one year along with a five-year maintenance agreement; and WHEREAS, the City of Miami ("City") has determined that all data be kept for a period for four (4) years due to the criticality of this data for liability purposes and to meet the retention criteria, additional storage devices must be acquired and installed as the current system is nearing maximum capacity; and WHEREAS, Dictaphone is the engineer, manufacturer, sole source seller and servicing agent of their own recording equipment and the equipment cannot be obtained from any other distributor other than Dictaphone to interface with the existing sole source Dictaphone Freedom recording equipment previously installed at the Police and Fire -Rescue Communications Unit; and WHEREAS, the Chief Procurement Officer has adopted a finding that Dictaphone is the sole source provider for the acquisition of four (4) Iomega Freedom E-Server Data Storage Devices, including installation and a five-year maintenance period, for the Department of Police ("Police"); and WHEREAS, the finding of the Chief Procurement Officer has been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Chief of Police recommend that the requirements for formal competitive sealed bidding procedures be waived and the procurement of the above equipment and service as specified be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by City of Miami Page I of 2 Printed On: 4/27/2005 File Number: 05-00374 reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote after an advertised public hearing, the City Manager's finding of a sole source waiving the requirements for competitive sealed bidding procedures, is ratified, approved and confirmed, and the acquisition and installation of four (4) lomega Freedom E-Server Data Storage Devices, for Police, from Dictaphone, the sole source provider, to include maintenance for five (5) years, is approved, for a total amount not to exceed $114,650.75, with funds allocated from the E-911 Operating Budget, Account Code No. 196003.290531.6.840. Section 3. The City Manager is authorized{1} to execute the necessary documents, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS/ r 0 L. ''ANDEZ CITY ALTO" N EY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
