HomeMy WebLinkAboutresolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miaml.tl.us File Number: 05-00373 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES; APPROVING THE ACQUISITION OF ELEVATOR MAINTENANCE AND REPAIR SERVICES AND ITS UTILIZATION OF ORIGINAL MANUFACTURER'S PARTS, FOR THE DEPARTMENT OF POLICE ("POLICE") HEADQUARTERS BUILDING AT AN ANNUAL COST NOT TO EXCEED $20,000, AND FOR THE DEPARTMENT OF CONFERENCES, CONVENTIONS AND PUBLIC FACILITIES ("CONFERENCES AND CONVENTIONS"), ORANGE BOWL STADIUM, AT AN ANNUAL COST NOT TO EXCEED $32,360, FROM THYSSENKRUPP ELEVATOR CORPORATION, THE SOLE SOURCE PROVIDER, FOR A ONE-YEAR PERIOD, WITH THE OPTION TO EXTEND FOR FIVE ADDITIONAL ONE-YEAR PERIODS; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE AN ELEVATOR MAINTENANCE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THYSSENKRUPP ELEVATOR CORPORATION; ALLOCATING SAID FUNDS FROM THE POLICE GENERAL OPERATING BUDGET, ACCOUNT CODE NO. 001000.290201.6.670 AND FROM CONFERENCES AND CONVENTIONS ACCOUNT CODE NO. 404000.350503.6.340. WHEREAS, the City of Miami's Department of Police ("Police") and the Department of Conferences, Conventions and Public Facilities ("Conferences and Conventions") are seelking to acquire elevator maintenance and repair services and the utilization of original manufacturer's parts for elevators located at the Police Headquarters Building and the Orange Bowl Stadium; and WHEREAS, ThyssenKrupp Elevator Corporation is the only authorized equipment manufacturer representative and the sole source provider of genuine original equipment manufacture's parts, proprietary software and hardware for the microprocessor and solid-state base equipment, and factory authorized service and repairs; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding of a sole source, waiving the requirements for competitive sealed bidding procedures is ratified, approved and confirmed, and the acquisition of elevator maintenance and repair services and original manufacturer's parts for the Police Headquarters Building and Conferences and Conventions at the Orange Bowl Stadium, from ThyssenKrupp Elevator Corporation, the sole source provider, for a one-year period, with the option to renew for five additional one-year periods, at an City of Miami Pagel of 2 P+ infed On: 5/3/2005 File Number: 05-00373 annual amount not to exceed $20,000, for Police, and in an annual amount not to exceed $32,360, for Conferences and Conventions, with funds allocated from the Police General Operating Budget, Account Code No. 001000.290201.6.670 and from the Conferences and Conventions Account Code No. 404000.350503.6.340. Section 3. The City Manager is authorized{1} to execute an Elevator Maintenance Agreement, in substantially the attached form, with ThyssenKrupp Elevator Corporation. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2) APPRO, D AS TO FORM AND CORRECTNESS: JORGE CITY A T NANDEZ RNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
