A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH BROWARD
COUNTY, TO SET FORTH THE PARTIES' RESPONSIBILITIES IN CONNECTION
WITH THE DEVELOPMENT AND SUPPORT OF THE FY 2003 URBAN AREAS
SECURITY INITIATIVE ("UASI) II PROJECT GRANT AND FY 2004 UASI III
PROJECT GRANT ADMINISTERED BY THE CITY OF MIAMI, AS A UASI
SPONSORING AGENCY; CONTINGENT UPON FUNDING OF THE PROJECT
BEING SECURED IN THE FORM OF GRANTS FROM THE UNITED STATES
DEPARTMENT OF HOMELAND SECURITY'S OFFICE FOR DOMESTIC
PREPAREDNESS AND THE STATE OF FLORIDA DIVISION OF EMERGENCY
MANAGEMENT.
WHEREAS, the United States Department of Homeland Security's Office for Domestic
Preparedness ("ODP"), through the State of Florida Division of Emergency Management ("DEM"), has
provided an Urban Areas Security Initiative ("UASI") II grant in the amount of $13,184,569 for Fiscal
Year 2003 and an UASI III grant in the amount of $19,033,677 for Fiscal Year 2004 to the City of Miarni
("City") and its contiguous counties, Miami -Dade and Broward Counties; and
WHEREAS, Ordinance No. 12394, adopted July 17, 2003, authorized the City Manager to execute
the documents necessary to accept the FY 2003 UASI III grant project funds in the amount of
$13,184,569, and, Resolution No. 04-0723, adopted November 18, 2004, authorized the City Manager
to execute the documents necessary to accept the FY 2004 UASI III project grant funds in the amount
of $19,033,677, be the sponsoring agency for the Miami urban area, appropriate funds for the
operation of same and authorized the expenditure of funds to various governmental agencies designed
for homeland security expenses pursuant to the UASI II and UASI III Project Grant guidelines; and
WHEREAS, in accordance with the FY 2003 UASI II and FY 2004 UASI III Project Grants, the
attached Memorandum of Agreement ("Agreement") with Broward County will provide the necessary
guidelines to coordinate the FY 2003 UASI II and FY 2004 UASI III Projects between Miami -Dade
County and Broward County to enhance the City's and its surrounding jurisdictions' ability to respond to
terrorist threats or acts and will permit the City to reimburse Broward County for its expenditures that
are compliant with the Project; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute a Memorandum of Agreement, in
substantially the attached form, with Broward County, to set forth the parties' responsibilities in
connection with the development and support of the FY 2003 UASI II and FY 2004 UASI III programs

administered by the City's Department of Fire -Rescue, contingent upon funding of the project being
received from the FY 2003 UASI !I and FY 2004 UASI I11 Project Grants from the U.S. ODP through
DEM.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{2}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
