WHEREAS, the title to the Warranty Deed Property may include such additional rights and other appurtenances as the fee -simple title to all or a portion of the alleyway that runs through the Warranty Deed Property, the fee -simple title to all or a portion of the public rights of way adjoining the Warranty Deed Property, as well as certain reserved riparian rights regarding the seawall and yacht basin to the east of the North Bayshore Drive. WHEREAS, Grantee has also acquired an assemblage of parcels to the east, south and southwest of the Warranty Deed Property from Flex Enterprises, Inc., by virtue of that certain Warranty Deed recorded in Official Records Book 22097, at Page 2136 of the Public Records of Miami -Dade County, Florida (the "Former Flex Property").
