Subject: Amending Code - Chapter 54 - Streets and Sidewalks
Purpose of Item:
Adopting Ordinance amending Chapter 54 of the Code of the City of Miami, Florida entitled Streets
and Sidewalks by amending Section 54-186 entitled "Established".
Background Information:

In order to improve the City's Parks infrastructure and provide the facilities necessary for the
enjoyment of City residents, the Parks Department has engaged in an aggressive program to complete
new recreation buildings and facilities in many of the City's parks. A new recreational building and
facility is scheduled to be constructed for Jose Marti Park on the section located east of Interstate 95.
In order to maintain the existing recreational facilities and preserve the open space currently enjoyed
by visitors to the park, it is necessary to locate the proposed recreational building on both sides of SW
5th Street between SW 3rd Avenue and Interstate 95 connected by an aerial portion of the building over
and across the SW 5th Street right of way. (Continued on attached Page 2)

AMENDING CODE — CHAPTER 54 — STREETS AND SIDEWALKS
The aerial portion will include the basketball gymnasium. The attached Ordinance will
allow this encroachment into the public right of way and expedite the building permit
procedure.
This project is funded from the Homeland Defense Bond Funds and construction of the
recreation building must commence by August 2005. In order to meet the schedule
deadlines and funding commitments, the adoption if this Ordinance on an emergency
basis is recommended.
