A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS
(4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING,
RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING
OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE
SEALED BIDDING PROCEDURES AND APPROVING THE ACQUISITION OF
EIGHTEEN (18) XTS1500 AND TWO (2) XTS5000 PORTABLE RADIOS WITH
SMARTNET SOFTWARE AND ACCESSORIES, FOR THE DEPARTMENT OF
PUBLIC WORKS, FROM MOTOROLA, INC., THE SOLE SOURCE PROVIDER,
FOR A TOTAL AMOUNT NOT TO EXCEED $33,246; ALLOCATING FUNDS FROM
THE FEDERAL GRANT ENTITLED, "URBAN AREAS SECURITY INITIATIVE
GRANT PROGRAM II," PROJECT NO. 110111, ACCOUNT CODE NO. 280910.6.

WHEREAS, the acquisition of the XTS1500 and XTS5000 portable radios with the Smartnet
software, and accessories, will allow the Department of Public Works to strengthen its readiness and
response, and ensure effective communications within the City of Miami ("City") and between local and
interagency organizations, with the provision of this equipment to its Operations personnel; and
WHEREAS, Motorola Inc. is the sole manufacturer of the City's existing 800 MHz radio system, its
portable radios with the Smartnet operating and maintenance software works in conjunction with this
system and is proprietary to Motorola Inc. and the City has previously determined the acquisition of
portable radios with the Smartnet software was a sole source; and
WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended, the
Chief Procurement Officer has adopted a finding that Motorola, Inc., is the sole source provider of the
XTS1500 and XTS5000 portable radios with the Smartnet software and accessories; and
WHEREAS, the finding of the Chief Procurement Officer has been approved and adopted as the
finding of the City Manager; and
WHEREAS, the City Manager and the Director of Public Works recommend that the requirements
for formal competitive sealed bidding procedures be waived and the procurement of the above as
specified be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA;
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City
Manager's finding of a sole source, waiving the requirements for competitive sealed bidding
procedures, is ratified, approved and confirmed, and the acquisition of eighteen (18) XTS1500 and two

(2) XTS5000 portable radios with the Smartnet software and accessories, for the Department of Public
Works, from Motorola, Inc., the sole source provider, is approved, for a total amount not to exceed
$33,246, with funds allocated from the Federal Grant entitled "Urban Areas Security Initiative Grant
Program II," Project No. 110111, Account Code No. 280910.6.840.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {1)

{1 } If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
