HomeMy WebLinkAboutR-05-0227City of Miami Legislation Resolution: R-05-0227 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-00279 Final Action Date: 4/14/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION, BYA FOUR -FIFTHS (4/STHS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING THAT IT IS NOT PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI TO CONDUCT COMPETITIVE SEALED BIDDING PROCEDURES, WAIVING SAID REQUIREMENTS, PURSUANT TO SECTION 18-85 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE COALITION TO END CHILDHOOD LEAD POISONING, INC., A NON-PROFIT ENTITY, TO PROVIDE TECHNICAL ASSISTANCE TO THE DEPARTMENT OF COMMUNITY DEVELOPMENT'S MIAMI UNLEADED PROGRAM, FOR A THREE-YEAR PERIOD, IN AN AMOUNT NOT TO EXCEED $225,000; ALLOCATING SAID FUNDS FROM THE SPECIAL REVENUE ACCOUNT ENTITLED "MIAMI UNLEADED PROGRAM," PROJECT NO. 184200. WHEREAS, pursuant to Resolution No. 04-0756, adopted November 18, 2004, the City Commission accepted a grant from the United States Department of Housing and Urban Development ("HUD") in the amount of $3,000,000 for the Miami Unleaded Program; and WHEREAS, the Coalition to End Childhood Lead Poisoning, Inc. ("Coalition") has extensive experience and has made valuable contributions in the field of lead hazard programs; and WHEREAS, the Coalition has played an integral part in legislation reform and has designed, developed, and provided direct delivery services to various HUD granted programs; and WHEREAS, said agency was included as part of the Miami Unleaded team in the proposal that was presented and approved by HUD; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding that it is not practicable or advantageous to the City of Miami to conduct competitive sealed bidding procedures, waiving the requirements for said procedures, pursuant to Section 18-85 of the Code of the City Miami, Florida, as amended, is ratified, approved and confirmed. The City Manager is authorized{1} to execute a Professional Services Agreement, in substantially the attached form, with the Coalition to End Childhood Lead Poisoning, Inc., to provide technical assistance to the Department of Community Development's Miami Unleaded Program, for a three-year period, in an amount not to exceed $225,000, with funds allocated from the special revenue account entitled "Miami Unleaded Program," Project No. 184200. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
