A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH
ATTACHMENT(S), AUTHORIZING AMENDMENT NO. 1 TO THE PROFESSIONAL
SERVICES AGREEMENT ("AGREEMENT") DATED OCTOBER 10, 2004, WITH T.Y.
LIN INTERNATIONAL/ H.J. ROSS, PURSUANT TO REQUEST FOR
QUALIFICATIONS NO. 02-03-163, FOR THE PROVISION OF CIVIL ENGINEERING
SERVICES FOR STORM WATER SEWER/ROAD IMPROVEMENT/DREDGING
PROJECTS ON A CONTINUING BASIS FOR SPECIFIED PROJECTS, IN AN
AMOUNT NOT TO EXCEED $750,000, INCREASING THE CONTRACT FROM
$500,000 TO $1,250,000, FOR ADDITIONAL WORK AND POST DRAINAGE
SERVICES FOR CURRENT DESIGN PROJECTS; ALLOCATING FUNDS FOR SAID
INCREASE, IN A TOTAL AMOUNT NOT TO EXCEED $750,000, FROM THE
CAPITAL IMPROVEMENT PROGRAM PROJECTS' BUDGETS AS STATED
HEREIN; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO
SAID AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID
PURPOSE.
WHEREAS, the City of Miami ("City") and T.Y. LIN International/H.J. Ross entered into a
Professional Services Agreement ("Agreement") on October 10, 2004, for the provision of civil
engineering services for storm water sewer/road improvement/dredging projects on a continuing basis
for specified projects pursuant to Request for Qualifications("RFQ") No. 02-03-163 conducted in
compliance with Section 287.55 Florida Statute and Section 18-87 of the Code of the City of Miami,
Florida, as amended; and
WHEREAS, the Department of Capital Improvements and Transportation has issued four (4) work
order authorizations totaling $475,694 for the following four (4) large drainage projects:(1) Fairlawn
Storm Sewer Improvements - Phase 3; (2) Tamiami Storm Sewer Improvements; (3) Flagami/West
End Storm Water Pumps 1,2,3 & 4 and (4) Fairlawn Storm Sewer Improvements - Phase 2; and
WHEREAS, the current remaining contract balance, of $24,306, is not sufficient to cover the costs
remaining for post -design work to complete these projects or for any new work assignments; and
WHEREAS, all these projects are a part of the same drainage basin, thus it is to the City's best
interest to have the same firm work on all of them; and
WHEREAS, it is accepted standard practice in drainage projects to negotiate and authorize
additional work at the conclusion of each phase of the project; and
WHEREAS, the work to be performed with this contract increase is within the scope of the
foregoing RFP; and
WHEREAS, it is necessary to increase the contract amount by $750,000 to cover the anticipated
costs of additional work phases required for the projects entitled "Tamiami Storm Sewer

Improvements Project, B-50706" (estimated at an amount not to exceed $300,000), "Fairlawn Storm
Sewer Improvements Project, Phase 3, B-50704," (estimated at an amount not to exceed $300,000)
and for post -design services to current design projects entitled "Flagami/West End Storm Sewer
Improvements Project, Phase II, B-50695" (estimated at an amount not to exceed $75,000) and
"Fairlawn Storm Sewer Improvements Project, Phase II, B-50703 (estimated at an amount not to
exceed $75,000); and
WHEREAS, due to the additional work, a contract increase in an amount not to exceed $750,000
will increase the contract from $500,000 to $1,250,000; and
WHEREAS, funds for the additional professional engineering services and expenses are
available from project budgets B-50706 in the amount not to exceed $300,000, B-50704 in the
amount not to exceed $300,000, B-50695 in the amount not to exceed $75,000 and B-50703 in the
amount not to exceed $75,000;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. Amendment No. 1 to the Agreement dated October 10, 2004, with T.Y. LIN
International/ H.J. Ross, pursuant to RFQ No. 02-03-163, for the provision of civil engineering
services for Storm Water Sewer/Road Improvement/Dredging Projects on a continuing basis for
specified projects, is authorized, in an amount not to exceed $750,000, increasing the contract from
$500,000 to $1,250,000, for additional work and post drainage services for current design projects,
with funds allocated in a total amount not to exceed $750,000, from Capital Improvement Program
Budgets B-50706, in the amount not to exceed $300,000, B-50704 in the amount not to
exceed $300,000, B-50695 in the amount not to exceed $75,000 and B-50703 in the
amount not to exceed $75,000.
Section 3. The City Manager is authorized{1} to execute an amendment to said Agreement, in
substantially the attached form, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
