Authorizing the City Manager to negotiate a purchase and sale agreement with the top - ranked firm. Further authorizing the City Manager to negotiate an agreement with the second -ranked firm, in the event that the top -ranked firm requires extraordinary zoning approval or should negotiations fail. Directing that the negotiated agreement be presented to the City Commission for consideration. Background Information: -- The City Commission previously approved Resolution 03-591, declaring as surplus, the property located at 400-430 S.W. 8th Avenue. An RFP was issued to find an experienced developer to purchase, plan, design, develop and construct a mixed -used project on the site. Three proposals where received and evaluated by the Evaluation Committee. The Evaluation Committee recommended that the City negotiate a Purchase and Sale Agreement with the top -ranked firm, Amco Holdings LLC and should negotiations fail or if their project's design requires extraordinary zoning approvals, the City Manager, at his sole and reasonable discretion, could proceed to negotiate with the second -ranked firm, El Teatro Development LLC, with the condition that they include a retail component and sufficient parking spaces.
