RESOLUTION NO. 0 3- 5 9 1
A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH
ATTACHMENT(S),, DECLARING CERTAIN CITY -OWNED REAL
PROPERTY LOCATED AT 400-430 SOUTHWEST 8TH AVENUE,
MIAMI, FLORIDA ("PROPERTY"), AS DESCRIBED IN
"EXHIBIT A," ATTACHED AND INCORPORATED, AS SURPLUS
REAL PROPERTY; AUTHORIZING AND DIRECTING THE CITY
MANAGER TO SELL SAID CITY -OWNED REAL PROPERTY;
FURTHER AUTHORIZING THE CITY MANAGER TO: (1)
ESTABLISH THE MINIMUM SALES PRICE FOR THE PROPERTY
TAKING INTO CONSIDERATION THE APPRAISED VALUE OF
THE PROPERTY AS ESTABLISHED BY THE RESULTS OF TWO
INDEPENDENT APPRAISALS; (2) EMPLOY SUCH PROCEDURES
AS MAY BE REQUIRED BY THE CITY CHARTER OR CODE FOR
PURPOSES OF DISPOSING OF THE PROPERTY; (3) ACCEPT
RESPONSIVE AND RESPONSIBLE BIDS; (4) NEGOTIATE A
PURCHASE AND SALE AGREEMENT; AND (5) PRESENT THE
NEGOTIATED AGREEMENT TO THE CITY COMMISSION FOR
CONSIDERATION.
WHEREAS, the City Commission wishes to declare the
City -owned real property located at 400-430 Southwest 8th Avenue,
Miami, Florida, as surplus real property;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. City -owned real property located at 400-430
Southwest
8 th
Avenue, Miami, Florida ("Property"), as described
in "Exhibit A," attached and incorporated, is declared as
surplus.
Section 3. The City Manager is authorizedli and directed
to sell said City -owned surplus real property and to: (1)
establish the minimum sales price for the Property taking into
consideration the appraised value as established by the results
of two independent appraisals; (2) employ such procedures as may
be required by the City Charter or Code for purposes of
soliciting offers for the purchase or lease of the Property;
(3) accept responsible and responsive bids; (4) negotiate a
purchase and sale agreement; and (5) present the negotiated
agreement to the City Commission for consideration.

The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Charter and Code provisions.

Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor./

If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.
