AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION, WITH
ATTACHMENT(S), REVISING APPROPRIATIONS FOR CERTAIN CAPITAL
IMPROVEMENT PROJECTS SCHEDULED TO BEGIN IN FISCAL YEAR 2004-2005;
AUTHORIZING THE CITY MANAGER TO ACCEPT FUNDS IN THE AMOUNT OF
$750,000, CONSISTING OF A FEDERAL EMERGENCY MANAGEMENT AGENCY
ASSISTANCE TO FIREFIGHTERS GRANT FOR FISCAL YEAR 2004;
AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT AGREEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE; AMENDING
ORDINANCE NO. 12622, ADOPTED DECEMBER 9, 2004, TO APPROPRIATE SAID
FUNDS INTO CAPITAL IMPROVEMENT PROJECT NO. 313303 ENTITLED "FIRE
DEPARTMENT COMPUTERS AND COMMUNICATIONS;" CONTAINING A
REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Ordinance No. 12622, adopted December 9, 2004, established the appropriations
for Capital Projects for Fiscal Year 2004-2005; and
WHEREAS, the City of Miami ("City") Capital Improvement Projects have been reviewed and,
in some cases, ongoing capital projects have been revised and respective appropriations increased
or decreased in their totals; and
WHEREAS, this Ordinance includes new capital projects scheduled to begin during Fiscal
Year 2005 and appropriates the project funding totals; and
WHEREAS, the Federal Emergency Management Agency ("FEMA") has awarded the
Department of Fire -Rescue an Assistance to Firefighters Grant for Fiscal Year 2004 in the amount of
$750,000, with required matching funds of $480,894; and
WHEREAS, said grant funds will be appropriated into Capital Improvements Project ("CIP")
No. 313303, entitled: "Fire Department Computers and Communications," in the amount of $750,000;
and
WHEREAS, matching funds in the amount of $480,894 are available for said grant from CIP
No. 313303 funded by the Fire Assessment Fee; and
WHEREAS, this Ordinance is declared to be an emergency measure on the grounds that it is
necessary to safeguard the health, safety, welfare and convenience of the City, specifically to ensure
that funding is in place to commence time -sensitive projects under the Homeland
Defense/Neighborhood Improvement Bond Program;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,

FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to accept funds in the amount of $750,000,
consisting of a FEMA Assistance to Firefighters Grant for Fiscal Year 2004, and to execute a Grant
Agreement, in substantially the attached form, for said purpose.
Section 3. Ordinance No. 12622, adopted December 9, 2004, the Capital Projects
Appropriations Ordinance, is amended in the following particulars: {2}
"Ordinance No. 12622
Section 1. The herein appropriations are made for implementation of all municipal capital
improvements of the City of Miami, including new capital improvement projects scheduled to begin
during Fiscal Year 2005. The herein appropriations which are hereby designated by reference to
descriptive project title and number also include appropriations for previously approved scheduled
projects as well as reappropriations of prior funds. The sources of revenues to support the herein
appropriations are hereby identified by fund and project in ten Capital Funds, as follows:

Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict
with the provisions of this Ordinance, are repealed.
Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance
is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance is declared to be an emergency measure on the grounds of urgent
public need for the preservation of peace, health, safety, and property of the City of Miami, and upon
further grounds of the necessity to make the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases of goods and supplies and to
generally carry on the functions and duties of municipal affairs.
Section 7. The requirement of reading this Ordinance on two separate days is dispensed with
by an affirmative vote of not less than four -fifths of the members of the Commission.
Section 8. This Ordinance shall become effective immediately upon its adoption and signature
of the Mayor. {3}

effective immediately upon override of the veto by the City Commission or upon the effective date
stated herein, whichever is later.
