PETITION Consideration of a modification to a covenant for the property located at 2947-49 SW 22nd Terrace, Miami, Florida. PLANNING RECOMMENDATION Denial. BACKGROUND AND ANALYSIS The proposed modification to the covenant for the property located at 2947-49 SW 22nd Terrace, Miami, Florida, also known as the "Latin American Cafeteria" property, is for the purpose of relaxing certain terms of said covenant. The request includes allowing for egress from the commercial property onto SW 22nd Terrace and moving the required wall from the 20-foot setback line right up to the property line along SW 22nd Terrace. The properties located across the street along SW 22nd Terrace are zoned R-2 Duplex Residential. The Planning and Zoning Department is recommending denial based on findings that the conditions of this covenant were enacted in order to protect the adjacent residential area from the detrimental effects of commercial intrusion. Although it is understood that conditions have changed in the neighborhood, the fact that the neighborhood still requires protection from incompatible commercial encroachment remains the same. The release or modification of these conditions may result in adverse impacts on the adjacent neighborhood.
