HomeMy WebLinkAboutR-05-0200City of Miami Legislation Resolution: R-05-0200 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-00298 Final Action Date: 3/24/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY ATTORNEY TO TAKE ANY AND ALL ACTIONS NECESSARY IN LAW OR IN EQUITY TO: 1) VOID THE SETTLEMENT AUTHORIZED BY RESOLUTION NO. 04-0748, ADOPTED NOVEMBER 18, 2004 AND 2) RECOUP THE SETTLEMENT FUNDS ALREADY PAID, IN THE CASE OF EVA NAGYMIHALY, ET AL., VS. CITY OF MIAMI, CASE NO. 98-11208 CA 01 ; FURTHER ALLOCATING AN AMOUNT NOT TO EXCEED $200,000, TO RETAIN THE LAW FIRM OF COLE, SCOTTAND KISSANE, P.A., AS OUTSIDE COUNSEL, PLUS ANY ADDITIONAL COSTS OF LITIGATION INCLUDING BUT NOT LIMITED TO RETENTION OF EXPERTS AND CONSULTANTS, AS APPROVED BY THE CITY ATTORNEY. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Attorney is authorized to take any and all actions necessary in law or in equity to: 1) void the settlement authorized by Resolution No. 04-0748, adopted November 18, 2004 and 2) recoup the settlement funds already paid, in the case of Eva Nagymihaly, et al., vs. City of Miami, Case No. 98-11208 CA 01, with funds allocated in an amount not to exceed $200,000, to retain the law firm of Cole, Scott and Kissane, P.A., as outside counsel, plus additional costs of litigation including but not limited to retention of experts and consultants, as approved by the City Attorney. Section 2. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
