A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH
ATTACHMENT(S), ADOPTING THE FINDINGS OF MIAMI-DADE COUNTY
("COUNTY") THAT: A BLIGHTED OR SLUM AREA EXISTS IN THE MIDTOWN
REDEVELOPMENT AREA; THAT REBUILDING, REHABILITATION,
CONSERVATION, AND REDEVELOPMENT OF THE AREA IS NECESSARY IN THE
INTEREST OF THE PUBLIC HEALTH, SAFETY, MORALS, AND WELFARE OF THE
RESIDENTS OF THE CITY OF MIAMI ("CITY") AND THE COUNTY; THAT
THE REDEVELOPMENT AREA IS A SLUM OR BLIGHTED AREAAS DEFINED IN
SECTION 163.340, FLORIDA STATUTES; AND THAT THERE IS A NEED FOR A
COMMUNITY REDEVELOPMENT AGENCY TO CARRY OUT THE
REDEVELOPMENT PURPOSES PROVIDED FOR IN FLORIDA'S COMMUNITY
REDEVELOPMENT ACT OF 1969; ACCEPTING THE COUNTY'S DELEGATION OF
AUTHORITY TO CREATE A COMMUNITY REDEVELOPMENT AGENCY;
CREATING THE MIDTOWN COMMUNITY REDEVELOPMENT AGENCY
("MIDTOWN CRA"), WITH GEOGRAPHIC BOUNDARIES AS SET FORTH IN
"EXHIBIT A," ATTACHED AND INCORPORATED; AND DECLARING THE CITY
COMMISSION TO BE THE MIDTOWN CRA SEPARATE, DISTINCT, AND
INDEPENDENT FROM THE CITY COMMISSION WITH ALL THE RIGHTS,
POWERS, PRIVILEGES, DUTIES, AND IMMUNITIES OF A COMMUNITY
REDEVELOPMENT AGENCY.
WHEREAS, Miami -Dade County ("County") Ordinance No. 03-271, adopted December 16,
2003, created the Midtown Miami Community Development District ("District") for the purpose
of delivering certain community development services and facilities within and outside the
boundaries of the District; and
WHEREAS, the development of the District is expected to benefit the citizens of the City of
Miami ("City") and the County by stimulating economic development and growth and
generating significant revenues for the City and the County; and
WHEREAS, Resolution No. 04-0288, adopted April 29, 2004, authorized an Interlocal
Agreement between the City, the County, and the District requiring the creation of a
Community Redevelopment Agency in the District to offset a portion of the cost of providing
certain infrastructure; and
WHEREAS, Resolution No. 04-0288 further authorized the City Manager to prepare a
"Finding of Necessity Study" in accordance with the requirements for the creation of a
Community Redevelopment Agency under Part III, Chapter 163, Florida Statutes, the
Community Redevelopment Act of 1969 ("Act"); and

WHEREAS the Finding of Necessity Study was transmitted to the County for its
consideration; and
WHEREAS, County Resolution No. 213-05, adopted March 1, 2005, concurred with the
Finding of Necessity Study and found that: the Midtown Redevelopment Area is a blighted or
slum area; that the rebuilding, rehabilitation, conservation, and redevelopment of the Midtown
Redevelopment Area is necessary in the interest of the public health, safety, morals, and
welfare of the residents of the City and the County as a whole; that the redevelopment area is
a slum or blighted area as defined in Section 163.340, Florida Statutes; that there is a need
for a community redevelopment agency to carryout the redevelopment purposes of the Act;
and further delegated the power to create a Community Redevelopment Agency to the City
with the sole power, initially, to prepare and adopt a redevelopment plan; and
WHEREAS, the City Commission wishes to adopt the County's findings and to create a
Community Redevelopment Agency for the Midtown Redevelopment Area;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission adopts the findings of the County that: a blighted or
slum area exists in the Midtown Redevelopment Area; that the rebuilding, rehabilitation,
conservation, and redevelopment of the area is necessary in the interest of the public health,
safety, morals, and welfare of the residents of the City and the County; that the
redevelopment area is a slum or blighted area as defined in Section 163.340, Florida
Statutes; and that there is a need for a Community Redevelopment Agency to carry out the
redevelopment purposes provided for by Florida's Community Redevelopment Act of 1969.
Section 3. The City Commission accepts the County's delegation of authority to create a
Community Redevelopment Agency and creates the Midtown Community Redevelopment
Agency ("Midtown CRA"), with geographic boundaries as set forth in "Exhibit A," attached and
incorporated.
Section 4. The City Commission declares itself to be the Midtown CRA separate,
distinct, and independent from the City Commission with all the rights, powers, privileges,
duties, and immunities of a Community Redevelopment Agency.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.{1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
