HomeMy WebLinkAboutR-05-0193City of Miami Legislation Resolution: R-05-0193 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-00203 Final Action Date: 3/24/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY THE SUM OF $600,000 TO SALE & KUEHNE, P.A., KENDALL COFFEY, P.A., GELLER, GELLER, GARFINKEL & FISHER AND GELLER, GELLER, BESKIN, SHIENVOLD FISHER AND GARFINKEL, L.L.P. , IN FULL SETTLEMENT OF ANY AND ALL CLAIMS AND DEMANDS AGAINST THE CITY OF MIAMI, FOR ATTORNEYS' FEES AND COSTS INCURRED FOR THE REPRESENTATION OF JOE CAROLLO, IN STATE AND FEDERAL LITIGATION PROCEEDINGS RELATED TO THE NOVEMBER 1997 ELECTION FOR MAYOR OF THE CITY OF MIAMI, AND A SUBSEQUENT CONTESTED CHARTER AMENDMENT, UPON EXECUTION OF A GENERAL RELEASE ON A FORM ACCEPTABLE TO THE CITY ATTORNEY; ALLOCATING FUNDS FROM THE CITY OF MIAMI SELF-INSURANCE AND INSURANCE TRUST FUND, INDEX CODE NO. 515001.624401.6.652. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Director of Finance is authorized to pay the sum of $600,000 to Sale & Kuehne, P.A., Kendall Coffey, P.A., Geller, Geller, Garfinkel & Fisher And Geller, Geller, Beskin, Shienvold Fisher And Garfinkel, L.L.P., in full settlement of any and all claims and demands against the City of Miami, for attorneys' fees and costs incurred for the representation of Joe Carollo, in state and federal litigation proceedings related to the November 1997 Election for the Mayor of the City of Miami, and a subsequent contested Charter Amendment, upon execution of a General Release on a form acceptable to the City Attorney, with funds allocated from the City of Miami Self -Insurance and Insurance Trust Fund, Index Code No. 515001.624401.6.652. Section 2. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
