File Number: 05-00200 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION FOR GRANT FUNDING TO THE FLORIDA INLAND NAVIGATION DISTRICT ("FIND") WATERWAYS ASSISTANCE PROGRAM, IN AN AMOUNT NOT TO EXCEED $62, 700, FOR THE ASSOCIATED COSTS TO REPLACE THE SEMINOLE PUBLIC DINGHY DOCK AT DINNER KEY MARINA PROJECT ("PROJECT"); AUTHORIZING THE ALLOCATION OF REQUIRED MATCHING FUNDS FOR THE PROJECT COSTS, IN AN AMOUNT NOT TO EXCEED $34,350, FROM THE DEPARTMENT OF CONFERENCES, CONVENTIONS AND PUBLIC FACILITIES FISCAL YEAR 2005 GENERAL FUND OPERATING BUDGET ENTITLED "DINGHY DOCK REPLACEMENT;" FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, FOR SUBMISSION OF THE FIND GRANT APPLICATION FOR FISCAL YEAR 2005-2006, SUBJECT TO THE TERMS AND CONDITIONS OF SAID GRANT APPLICATION. WHEREAS, the City of Miami ("City") wishes to replace the Seminole Public Dinghy Dock at Dinner Key Marina ("Project"), including applicable engineering, design and permitting costs; and WHEREAS, the estimated cost of the Project is $62,700; and WHEREAS, the City wishes to apply for grant funding from the Florida Inland Navigation District ("FIND") for the Project in the total amount of $62,700, of which $28,350 will be funded by the FIND grant and $34,350 from the City's contribution of the required matching funds; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings found in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to submit an application for grant funding to the FIND Waterways Assistance Program, in an amount not to exceed $62,700, for the Project. Section 3. The allocation of required matching funds for the Project costs, in an amount not to exceed $34,350 from the Department of Conferences, Conventions, and Public Facilities Fiscal Year 2005 General Fund Operating Budget entitled "Dinghy Dock Replacement," is authorized. Section 4. The City Manager is further authorized{1) to execute all necessary documents, for submission of the FIND grant application for Fiscal Year 2005-2006, subject to the terms and conditions of said grant application. Section 5. The City accepts the terms and conditions set forth in FIND Rule 66B-2 F.A.C., which govern the Waterway Assistance Program and which is a part of the Project. The City is in complete accord with the proposal and agrees to carry out the Project in the manner described in the proposal, and will make no change to any plans and specifications, without prior approval from FIND. Section 7. The City will maintain adequate financial records for the proposed Project to substantiate claims for reimbursement. Section 8. The City will make available to FIND, upon request, a post audit of expenses incurred on the Project prior to, or in conjunction with, the request for the final ten percent (10%) of the funding agreed to by FIND. FERNANDEZ / CITY ATTORNEY �/ Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. (2) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
