Metric Engineering, Inc. 13940 SW 136 Street, Suite 200 Miami, Florida 33186 Re: SUPPLEMENTAL WORK ORDER AUTHORIZATION "N.E. 71st Street Drainage Improvements, B-50690" Dear Mr. Reyna: This supplemental work order is for the provision of General Engineering services for "N.E. 71st Street Drainage Improvements, B-50690", herein after referred to as "Project", pursuant to the Professional Services Agreement for General Engineering services, dated May 13, 2002 between the City for Miami and Metric Engineering, Inc. The undersigned will perform this work in compliance with the foregoing Agreement. Additionally, this Agreement has been authorized by City Commission Resolution No. 02- 144 adopted February 14, 2002. The original work order for the Project entitled "N.E. Street Storm Sewers Project, B-50690, in an amount not to exceed $75,000, was adopted by Resolution No. 03-1192 dated November 25, 2003, as amended, by Resolution No. 04- 0400 adopted June 24, 2004 which increased the original work order in an amount not to exceed $20,250, from $75,000 to $95,250. The terms of any enabling resolution are deemed as being incorporated by reference herein. The undersigned will perform this work in compliance with any enabling resolution. I. Scope of Services The scope of services are detailed in the Proposal for engineering services, attached hereto and made a part hereof. II. Time of Performance The schedule for performance of the work is detailed in the Proposal for engineering services. The completion date schedule shall be adjusted to reflect the date of the written notice to proceed date. III. Compensation The work will be performed for a lump sum not -to -exceed the sum of $40,895.03 as further detailed in the Proposal for engineering services. The City shall not be liable for any cost, fee, or expenditure above the amounts set forth in this section. The above quoted fee includes an allowance for reimbursable expenses that comply with the requirements of the Agreement. IV. Sub -Consultants Sub -consultants for performance of the work are: For Disci line Hydro geological study and report Name of Sub -Consultant Firm URS • Any changes to the Sub -Consultants used for this work shall require prior written approval from the Director or the Project Manager, which approval shall not be un-reasonably withheld. V. Budget and Funding This work will be funded though the Capital Improvement Program Account (CIP) No. 352216, entitled "Citywide Local Drainage Projects FY 02-06". An estimated construction cost of $1,408,000 has been established for this project. Additional expenses, including design, construction inspections, and project administration bring the total budget of this project to $1,448,895.03. VI. OSHA (and ADA) Compliance The Consultant will allow City inspectors, agents or representatives the ability to monitor its compliance with safety precautions as required by federal, state or local laws, rules, regulations and ordinances. By performing these inspections the City, its agents, or representatives are not assuming any liability by virtue of these laws, rules, regulations and ordinances. The Consultant shall have no recourse against the City, its agents, or representatives from the occurrence, non-occurrence or result of such inspection(s). Upon issuance of a notice to proceed the Consultant shall contact the Risk Management Department at (305) 416-1800 to schedule the inspection(s). The Consultant shall affirmatively comply with all applicable provisions of the Americans with Disabilities Act ("ADA") in the course of providing any work, labor or services funded by the City including Titles I and II of the ADA (regarding nondiscrimination on the basis of disability) and all applicable regulations, guidelines and standards. Additionally, Consultant shall take affirmative steps to ensure nondiscrimination in employment of disabled persons. VII. Documents Attached and/or Incorporated By Reference The Work Order is deemed to incorporate by reference the terms and conditions of the documents identified below. The undersigned will perform this work in compliance with the provisions of those documents. 1. Proposal for Engineering services dated February 15, 2005 from Metric Engineering, Inc., including all Exhibits thereto. 2. The Professional Services Agreement for General Engineering services between Metric Engineering, Inc. and the City of Miami dated May 13, 2002. 3. City of Miami Resolution No. 02-144 adopted February 14, 2002. 4. City of Miami Resolution No. 03-1192 adopted November 25, 2003. 5.
