HomeMy WebLinkAboutR-05-0176City of Miami Legislation Resolution: R-05-0176 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-00189 Final Action Date: 3/24/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION FOR GRANT FUNDING TO THE FLORIDA DEPARTMENT OF STATE, DIVISION OF LIBRARY AND INFORMATION SERVICES, IN AN AMOUNT NOT TO EXCEED $500,000, FOR THE VIRRICK PARK LIBRARY ADDITION PROJECT ("PROJECT"); ALLOCATING THE REQUIRED MATCHING FUNDS, IN AN AMOUNT NOT TO EXCEED $500,000, FROM CAPITAL IMPROVEMENT PROJECT NO. B-30292, ENTITLED "VIRRICK PARK LIBRARYADDITION;" AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SUBMISSION OF THE GRANT APPLICATION FOR FISCAL YEAR 2005-2006, SUBJECT TO THE TERMS AND CONDITIONS OF SAID GRANT APPLICATION. WHEREAS, the City of Miami ("City") wishes to design and construct a 5,000 square foot public library in the West Coconut Grove area as requested by the Coconut Grove Homeowners Association, the Elizabeth Virrick Park Citizens Committee, the One Grove Alliance, the Cocoanut Grove Village Council, other local organizations and individual Coconut Grove residents; and WHEREAS, the Virrick Park Library Addition Project ("Project") will be located adjacent to Virrick Park's multi -purpose building and will complement after school and tutoring programs conducted by the Mayor's Mentoring Initiative, the Department of Parks and local not -for -profit organizations; and WHEREAS, the City will be responsible for designing and building the structure which will then be turned over to Miami -Dade County, pursuant to an Interlocal-Agreement, to furnish, equip and operate the library; and WHEREAS, the Project is estimated to cost $1,500,000 and requires additional funding; and WHEREAS, the City wishes to apply for grant funding from the Florida Department of State, Division of Library and Information Services, for the Project in the amount of $500,000 to be matched by City funds in the amount of $500,000 from the Homeland Defense Neighborhood Improvement Bonds for Capital Improvements Project No. B-30292 entitled "Virrick Park Library Addition;" WHEREAS, the required match will be available and unencumbered at the time of grant award; and WHEREAS, the total of the City funds and grant award will be sufficient and available to result in a completed library building; and WHEREAS, upon completion of the project, the Miami -Dade Public Library System will have sufficient funds to be available to operate the facility; and City of Miami Page 1 of 2 File Id: 05-00189 (Version: 1) Printed On: 11/2/2016 File Number: 05-00189 Enactment Number: R-05-0176 WHEREAS, the building will be used exclusively for the public library and related educational purposes for which constructed and any proposed changes in use will be submitted to the Division of Library and Information Services for approval if it is within 20 years of completion of the Project; WHEREAS, the City will competitively award construction management or design -build contracts and construction contracts based on the submission of sealed bids, proposals submitted in response to a Request for Proposals, proposals submitted in response to a Request for Qualifications, or proposals for competitive negotiations; and WHEREAS, awards to a private sector contractor are permitted by applicable municipal ordinance, and by state law including Section 255.20, Florida Statutes; and WHEREAS, if competitive negotiations are used, the award shall be in accordance with Section 287.055, Florida Statutes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to submit an application for grant funding to the Florida Department of State, Division of Library and Information Services, in an amount not to exceed $500,000, for the Project. Section 3. The required matching funds, in an amount not to exceed $500,000, are allocated from Capital Improvement Project No. B-30292, entitled "Virrick Park Library Addition." Section 4. The City Manager is authorized{1} to execute the necessary documents, in substantially the attached form, for submission of the grant application Fiscal Year 2005-2006, subject to the terms and conditions of said grant application. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
