HomeMy WebLinkAboutresolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.uas File Number: 05-00186 Final Action Date; A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT COMPETITIVE BIDDING PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS, WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ACQUISITION OF GOODS AND SERVICES, PURCHASED BY CHARLIE DELUCCA SR., FOR THE CONTINUED MAINTENANCE AND OPERATION OF THE CITY OF MIAMI'S INTERNATIONAL LINKS GOLF COURSE, EFFECTIVE MARCH 1, 2005, IN AN AMOUNT NOT TO EXCEED $1,666,074; ALLOCATING FUNDS FROM THE MELREESE GOLF COURSE GENERAL FUND ACCOUNT, ACCOUNT CODE NO, 416000-580285 FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 04-0227, adopted on April 8, 2004, the City of Miami ("City") executed a settlement agreement ("Settlement Agreement); and WHEREAS, pursuant to the Settlement Agreement, effective June 11, 2004, the City reacquired the management of the city -owned International Links Golf Course located at 1802 Northwest 37th Avenue, Miami, Florida, ('Golf Course") and has been responsible for the payment to the various vendors providing services to the Golf Course; and WHEREAS, also pursuant to the Settlement Agreement, the City entered into a professional service agreement with Charlie Delucca, Sr. ("Provider") for the management and operation of the Golf Course until December 31, 2007; and WHEREAS, pursuant to Resolution No. 04-0808, adopted on December 9, 2004, the City Commission ratified, approved and affirmed the City Manager's emergency finding, pursuant to Section 18-90 of the Code of the City of Miami, and waived the requirement for the competitive sealed bidding procedures for the procurement of goods and services for the Golf Course until February 2005 and WHEREAS, the City has a continued need to provide the goods and services for the maintenance and operation of the Golf Course; and WHEREAS, pursuant to Section 18-85 of the City Procurement Code, the City Manager has determined that it is practical and most advantageous for the City to waive the competitive sealed bids requirement for the acquisition of goods and services associated with the continued maintenance and operation of the Golf Course; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; City of Miami Page 1 of 2 Printed On: 3/1/2005 File Number: 05-00186 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding that competitive bidding procedures are not practicable or advantageous, waiving the requirements for said procedures, is ratified, approved and confirmed and the acquisition of goods and services, purchased by Charlie Delucca Sr., for the continued maintenance and operation of the City's International Links Golf Course, effective March 1, 2005, in an amount not to exceed $1,666,074 , is authorized, with funds allocated from the Melreese Golf Course General Fund Account, Account Code No. 416000-580285 for said purpose. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS: JORGE L. FERNANDEZ CITY ATTORNEY Footnotes: {1} if the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
