Subject: Resolution Granting an Easement to FP&L within Biscayne Bay

Resolution amending Resolution No. 03-1154, which t ' thorized the City Manager to grant a
temporary construction easement to Florida Powe Light Company (FP&L) for the period
beginning with the date of execution and cont. ing until completion of the project but not to exceed
one year, to provide for execution of a ne rant of Temporary Construction Easement to commence
upon execution and continuing until completion of the project but not to exceed one year for
staging/material storage and laydow 1fabrication in the areas more particularly depicted in
construction drawings P-1 through P-8, in connection with the dredging of the south channel of the
Port of Miami under the through City of Miami property located in submerged land.
Background Information:
The City Commission previously authorized execution of a Grant of Temporary Construction
Easement to FP&L for the relocation of two existing high voltage electrical cables, which relocation
is required due to the dredging of the south channel of the Port of Miami. The Temporary
Construction Easement has expired. On January 11, 2005, the City received a request from
ConsulTech Enterprises, Inc., contractor for FP&L, advising that clue to unforeseen delays in
obtaining the environmental permits necessary to relocate the electrical cables, the construction of the
project has not yet commenced. ConsulTech anticipates that the permits will be granted in the near
future and has estimated the construction will begin in March 2005 and will be completed within a
year.
