Fernan. 1 id Memb of the City Commission C'-- Attorney,* DATE: February 24, 2005 RE: Proposed Resolution for City Commission Meeting — March 10, 2005 Continued engagement of the law firm of Akerman, Senterfitt & Eidson, P.A. for representation of the City of Miami in the case of Young vs. City of Miami, et al., in the U.S. District Court for the Southern District of Florida, Case No. 99-2994-CIV-MARTINEZ (File No. 05-00135). The attached proposed Resolution seeks authorization for the continued engagement of the law firm of Akerman, Senterfitt & Eidson, P.A. for representation of the City of Miami only in the case of Young vs. City of Miami, et al., in the U.S. District Court for the Southern District of Florida, Case No. 99-2994-CIV-MARTINEZ, in the amount of $30,000 plus costs as approved by the City Attorney. The amount consists of $12,000 for outstanding invoices and $18,000 for the amount necessary to cover future invoices for work incurred but uninvoiced to the conclusion of the case. As a result of the indictments of several of the officers named as defendants in these cases, coupled with the guilty pleas of two of the named defendants, the City Attorney's Office is ethically prohibited from representation of any defendant in this lawsuit, including the City. Resolution No. 01-1300, adopted December 13, 2001, allocated $100,000, Resolution No. 03-117, adopted October 23, 2003, allocated $50,000, and Resolution No. 04-0222, adopted April 8, 2004, allocated $80,700, plus costs as approved by the City Attorney for this case. Approval of this Resolution will bring the total amount allocated to $260,700.
