AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY MANAGER TO ACCEPT UNITED STATES
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT ENTITLEMENT
GRANT FUNDS UNDER THE FOLLOWING PROGRAMS: COMMUNITY
DEVELOPMENT BLOCK GRANT, HOME INVESTMENT PARTNERSHIPS,
AMERICAN DREAM DOWNPAYMENT INITIATIVE, HOUSING OPPORTUNITIES
FOR PERSONS WITH AIDS, AND THE EMERGENCY SHELTER GRANT FOR
FISCAL YEAR 2005; AUTHORIZING THE CITY MANAGER TO EXECUTE THE
NECESSARY DOCUMENTS TO IMPLEMENT ACCEPTANCE OF SAID GRANTS;
CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the United States Department Of Housing and Urban Development ("U.S. HUD") has
advised the City of Miami ("City") of the entitlement grants to be received by the City under the
following programs: Community Development Block Grant ("CDBG"), Home Investment Partnerships
("HOME"), American Dream Downpayment Initiative ("ADDI"), Housing Opportunities For Persons
With AIDS ("HOPWA"), and the Emergency Shelter Grant ("ESG");and
WHEREAS, funds to be granted to the City under said programs are: (1) $9,398,140 to the CDI3G
Program, (2) $4,920,334 to the HOME Program (3) $137,300 to the ADDI Program (4) $10,351,000 to
HOPWA, and (5) $363,122 to ESG;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized(1) to accept entitlement grant funds from U.S. HUD
under the following programs: CDBG, HOME, ADD, HOPWA, and ESG, and to execute the necessary
documents, to implement acceptance of said grants.
Section 3. All ordinances or parts of ordinances that are inconsistent or in conflict with the
provisions of this Ordinance are repealed.
Section 4. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is declared to be an emergency measure on the grounds of urgent
public need for the preservation of peace, health, safety, and property of the City, and upon the further
grounds of the necessity to make the required and necessary payments to its employees and officers,

payment of its debts, necessary and required purchases of goods and supplies, and to generally carry
on the functions and duties of municipal affairs.
Section 6, The requirements of reading this Ordinance on two (2) separate days is dispensed with
an affirmative vote of not less than four -fifths (415ths) of the members of the City Commission.
Section 7. This Ordinance shall become effective immediately upon its adoption and signature of
the Mayor. {2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by the City Attorney,
including but not limited to those prescribed by applicable City Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
