Mr. Miguel Gabela offered the following resolution and moved its adoption
Resolution:
AFTER CONSIDERING THE FACTORS SET FORTH IN SECTION 1305 OF ORDINANCE NO.
11000, THE ZONING BOARD RECOMMENDED APPROVAL TO THE CITY COMMISSION OF
THE SPECIAL EXCEPTION AS PART OF A MAJOR USE SPECIAL PERMIT FOR THE
SILVERTON PROJECT, AS LISTED IN ORDINANCE NO. 11000, AS AMENDED, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT
REGULATIONS, TO ALLOW A MULTIFAMILY RESIDENTIAL STRUCTURE OF DENSITY
EQUAL TO R-3 OR HIGHER IN THE C-2 DISTRICT FOR THE PROPERTIES LOCATED AT
APPROXIMATELY 300, 324, 326, 338, 342 AND 344 NORTHWEST 36TF STREET, LEGALLY
DESCRIBED AS LOTS 1 THROUGH 7, BLOCK 1, LESS THE NORTH 5 FEET FOR ROAD
PURPOSES, NORTHERN BOULEVARD TRACT (2-29), PUBLIC RECORDS OF MIAMI-DADE
COUNTY, FLORIDA; ZONED C-2 LIBERAL COMMERCIAL. THIS SPECIAL EXCEPTION WAS
RECOMMENDED FOR APPROVAL TO THE CITY COMMISSION PER PLANS ON FILE WITH
A TIME LIMITATION OF TWENTY-FOUR MONTHS IN WHICH A BUILDING PERMIT MUST BE
OBTAINED, SUBJECT TO THE FOLLOWING CONDITIONS BY THE PLANNING AND ZONING
DEPARTMENT: 1) THE APPLICANT SHALL PRESENT FINAL DESIGN DETAILS ON THE
FACADES, INCLUDING COLOR, SIGNS AND MATERIALS FOR REVIEW AND APPROVAL BY
THE PLANNING DIRECTOR PRIOR TO THE ISSUANCE OF A BUILDING PERMIT AND 2)
THIS APPROVAL SHALL BE SUBJECT TO ALL ADDITIONAL CONDITIONS SPECIFIED IN
THE FINAL DEVELOPMENT ORDER OF THE MAJOR USE SPECIAL PERMIT FOR THE
PROJECT.
